    Wow thanks for the quick reply -

    The load was taken with Firstplus in Feb 2006 (over term of 25yrs) and settled Oct 06 (I know!!).

    I can't get my head around how much they 'owe' but the settlement fig was 49k.

    If FOS are handling it now and you have been assigned an adjudicator then it should not be long now. If Laini comes on later she will tell you how long after this time usually or Di. You really should let FOS do it now.

    make sure they are regulated by the ministry of justice, www.claimsregulation.gov.uk but if they haven't heard of the fscs then they may not know all the ins and outs of reclaiming PPI - and for anyone who's been on here long enough to know it's sometimes not that easy !!!

    tell them you won't settle for that and that you're taking your complaint to the FOS, in fact send them a copy of the complaint form as 'a courtesy'

    You may have already come across this somewhere but its a good site and I know it has helped loads.;)

    I was caught in that overpayments web and put them straight, I know these can be difficult and do not pay back more than you can afford.;)

    No Di, this is when the tax credits first came out and people did not know of them so we can claim for these years. Its only worth about £520 per year for one child regardless of if you have two to twenty kids but to claim you have to submit some forms to them before a certain time limit. I don't owe them anything, they owe it to me. If you want info on it let me know. It should have been applied to the higher earners tax code and it was not.

    Today they then got back to me within an hour of me sending this and said they investigated to be sure we were eligible etc and confirmed we were, where a form will be posted out, unfortunately they do not send forms by electronic means as I had requested this by email afterwards, and there is no guarantee of when we will receive the form but its a way forward and they will still review this no matter when the form arrives.;)

    Have sent an email, were they asking for evidence to back up that the company were in receivership?

    Right okay hun, so a reclaim letter has already been sent to them and the offer was very low !

    I would write back and use the template letter on this site to tell them that you believe this was mis sold, call it a start again letter, if you look above in the red box it states 'reclaim £1,000's check out the list of mis selling and see what is what with your parents, then there is a link for a template, get it done send it off by recorded post and complain.

    We had to check on the date to make sure that it was elgible for the finanical ombudsman service if you need to do this.
    I see you have acted on the rebate but not the mis selling part, so do a complaint letter and complain it was mis sold.

    This was covered by the FSA so that is cool.;)

    Hi hun

    You should get a reply by next Monday now from the FSCS.;)

    I did actually scan my letter from the liquidators and sent it as an attachment to them but as long as you let them know the name of the company that went into receivership they will and should check this out for themselves.;)

    hi guys, i have previously posted on this thread regarding a ppi claim against Black Horse ltd- the ombudsman will not deal with the claim because the car loan was taken out in feb 2004 and black horse has only come under their regs in jan 2005. so i followed tiggrae's suggestion to take them back as lloyds tsb/ta black horse but i just had the very same - no can do - repply from the ombudsman.
    which other financial authority deals with ppi claims? could the FSA help?
    tiggrae, you have suggested fileing a complaint(?) under 1967 misprepresentation act for negligent misprepresentation- how do i do that? is this with the small claims court?

    unfortunately the FOS is the FSA's complaint Ombudsman so if the FOS have rejected your claim there isn't any other government body who can help. So your only recourse is the County Court - so long as the claim is under £5k then it will be allocated to the small claims track (court). You need to file an N1 claim form either with your local county court or through the on-line court system Money Claim On Line (mcol) where it's actually cheaper but you have to keep the particulars of the claim short (1400 words I think).
