There are firms who will submit a SAR and go through all of the paperwork to check if it comes under the heading of unenforceable/voidable, then pass it to a solicitor. The solicitor takes it to court and tries to get the loan quashed.
(this is my understanding of the process, there are folk on this board who know the ins and outs of the process)

Yes I recall now on you saying about your parents loan was also in 2004.
Mine was for £21,000 then obviously the PPI gets thrown in on top as a front loaded policy.
The PPI was over £3K, but the total loan paid in to settle was well over £23K and that was paying a 25 yr loan off in just a year.
Was checking the calculations and what they received in total was that of over £26K !
I see your parents was a lot more ? where they been ripped off :mad: , so sorry to hear that !!! I hope they get ALL their money back hun.;)
Mine was regulated agreement, and am aware after £25K its unregulated, so would there certain rules sort of thing for each one ?;)

I have letters like that 'non advised' but in my opinion they still had rules/points to follow advised or non advised !!!!
I think they say this to try and cover their butts hun......:mad: .
Over a month ago I won a claim of PPI with LV (Liverpool Victoria), this loan was in 2003, I had wrote to them and within 3 weeks they refunded over £1.5 which was right with the 8% interest, okay not a big claim but they did not argue and even stated it was then a 'non-advised' sale.
No quibbles with that one.
Thing is what have they got to really prove that it was sold correctly? to you - nothing in my opinion !!
Somewhere I read on the net where there is a list of rules that they should follow, and this was a non advised sale, will see if I can find it and add it here when I do come across it.;)

3 weeks prior to applying ( i have my letter from the doc to the neurologist here) i had been experiencing some very strange dizziness with a rapid nystagmus and could not walk straight. (had been on/off since my 2nd child was born and developed a malignant hypertension too).I went to my docs and she advised me that she thought i had a thrombosis and that i was being referred to a neurologist. We actually thought it was the start of MS or worse still a brain tumour. I then wanted to get some things straight and that is when we got on with the finances. I was actually diagnosed later with a condition called Benign Positional Vertigo which was a relief but still needed an MRI brain scan as some of the visable symptoms were not typical of the disease.( and i was just too young to get this). I am ok now but at the time it was so worrying. We just wanted to get things sorted and we did not argue the ppi and thought that they were a nice company and that was what everyone had to do.

Loan was for £40K, £6000+ PPI over 7.5 years. Unregulated as over £25K ... didn't know there was such a thing until a few weeks ago - this place certainly teaches you!
I think there was commission paid, which my parents knew nothing about, and also stuff missing from the SAR (my opinion, but it doesn't give a complete picture)

I am very very sorry to hear of all your health problems hunni, how devastating, and so pleased to hear your okay now, but golly what a damn worry.
Yep I thought the loan companies we had were all very nice but OMG on some of the SAR's that we recently received, especially from Nemo on the advance stage, they made all these unprofessional comments where I have a good mind to take this further when I've sorted lots of other stuff, I will tell you more on that again but the comments were very sarky, and hurtful too I thought......:mad: .
I can't believe that company have put you through all this hassle !!:mad: .
You do have a good case really hun, and my hubby has a permanent back condition, this was due to an accident years ago, we had made them aware of this and like yourself on some policies the PPI was added, or we were told we HAD to have this to be accepted for Credit !!!:mad: .
Honestly they just don't care, but to hear your story I am sooooo tamping here !!! sorry :mad:

Yes commission is normally paid to the brokers hun, I do in fact have a bit of paperwork here that was amongst the SAR I received, will dig it out, yet I didn't know this myself until I seen it on the paperwork.
Did you write to them again hun about that you don't believe you have received everything in the SAR ? They should supply everything they have on the account from beginning to end and even if its still in force.
You could write back and threaten them you will report them to the ICO if they do not FULLY COMPLY with your SAR request. (Information Commissioners Office), if you have not done this and need a letter let me know I will see what I can find, because I used one again on Endeavour.;)

Hi Laini hunni....;) .
From my experience with Nemo, they don't rush, and again from my experience they always request for extra time, okay the FOS normally give it but only a limited time.;)
If you email Nemo, always forward a copy to the FOS, I done this and then the FOS will have everything, and all the information if that makes any sense ?
Because from here its all under the wings of the FOS, and they will always respect it if you kept them updated with any contacts and vica verca you've had.;)
When I was emailing Nemo, my caseworker did suggest this to me when the case was under the FOS themselves.
I know you have told me before hun, but when did this actually go in with the FOS ?

Right then, okay, its been with the FOS since Jan 08, so it should be anytime you should receive some feedback or at least an update, Nemo could do with a push really couldn't they ?:mad:
Very helpful to have the same guy, this goes to prove its not the FOS taking his time but Nemo being soooo slow like they were with me......:mad: , well the FOS will not wait forever for them hun and will have to make his own decision without waiting to hear from them lagging it on, they had a bad habit requesting for extra time all the time, the FOS gave it but his own deadline and not their's lol....:D .

Thanks Di, i am not a sympathy type person so i have never informed them of any of this but i have got my letters here from our docs and neurologist. Also when i settled the loan I had a breast lump and i was waiting for my biopsy. My solicitor settled with them as i had had enough and the arguing with them (firstplus) and not knowing the outcome was just too much. My solictor requested the figure on 21st March 2003 and i had my breast appointment on 10th April. (got letter here)Again another worrying time. We thought the worst and just wanted to get things sorted. Firstplus gave us such a hard time at settling. I was going through all this and they just kept saying that we knew everything at the time we took the loan out. What crap.0 -

Yup, I've written back to them asking for any recorded phone conversations, as the initial application was taken out with Norton over the phone.
There was no info regarding the PPI, so I've asked them for that also.
My letters are very polite and formal, but also convey the message "sort this or you'll be sorry" :rotfl: They'll probably ignore me, so I might need your heavy letter
My parents are quite proud of me - they reckon it could become a whole new career :rotfl:
I'm tempted to just camp on their doorstep being embarrassing until they sort it out. Their offices aren't all that far away :rotfl:
The SAR paperwork shows commission of over £3K on one document, but a "no commission" tickbox on another. Don't know how we'd find out whether commission was paid or not.
