PPI Reclaiming discussion Part II

After my success with HSBC and FirstPlus I set about Barclays one for my friend and the other for me my friend has sorted hers, but I could find no paperwork for mine. SoI asked them for details they came back saying that there was no PPI added to my loan and it was unprotected, like I said I had no paperwork but I was sure that I did have PPI, so asked them to check again but they said no it was unprotected. 2 days ago I found the paperwork and guess what there it was in black and white PPI in a single premium. I am upset that they tried to pull the wool over my eyes because I informed them I had no paperwork and I have told them this and they say that it was just a mistake but if I had never found the paperwork they would never have investiagted it, so just a warning to you all never ever trust them. I am now writing to Head Office with a complaint at the way this was dealt with any ideas what to put.Claimed back almost £4000 so far from HSBC for mis-sold PPI
£2083.00 + £242.00 8% interest from FirstPlus and lower monthly premiums:D Studio Cards paid off my account and gave me £125.00 in gift vouchers. £500.00 Barclays.0 -

I dont want o step on the FOS s toes but its frustrating so sending hand written notes from NEMO to FOS to try and move it along.
still looking for car and job so bit down at the moment but relieved we have cash to pay for things

And don't stop with a complaint to their Head Office. Take it to anyone that will listen. I'm sure these lies and deceit are widespread across financial institutions and I'm starting to come round to my Gran's idea that these places should not be trusted and the only place to keep your money is under the bed. At least then if someone tries to take it, it's obvious and not shielded by lies and small print.Almost debt-free, but certainly even with the Banks!0

Hi Laini hunni....;) .
From my experience with Nemo, they don't rush, and again from my experience they always request for extra time, okay the FOS normally give it but only a limited time.;)
If you email Nemo, always forward a copy to the FOS, I done this and then the FOS will have everything, and all the information if that makes any sense ?
Because from here its all under the wings of the FOS, and they will always respect it if you kept them updated with any contacts and vica verca you've had.;)
When I was emailing Nemo, my caseworker did suggest this to me when the case was under the FOS themselves.
I know you have told me before hun, but when did this actually go in with the FOS ?

I just want to know how i stand with this advised/non advised ppi sale. When i complained to Firstplus about the settlement of my loan because of this single/front loaded policy i was told (got if from my SAR) by Firstplus that the literature and advice was given to me by my broker Wilmslow/Freedom at the application. I was later informed by Freedom/Bespoke that this was a non advised sale. Why would they say that?? Does saying non advised mean that they are protected more than me? Firstplus state in telephone convo's it was advised.0

The lender was Endeavour but my broker was Click who've dissolved, so I have been looking at other ways of pursuing these through their links, such as the HFC group, because we had received the final decision from Endeavour who will not be held responsible, and keep telling me to redress through the broker who I've told many times they've dissolved.....:rolleyes: , they still keep telling me to do this, its been with the FOS but as Endeavour were not regulated in July 2004 the FOS could not proceed with this complaint.
Okay I need to know more about this enforecable/voidable route, if you or anyone could please let me know more about this and how I deal with this, thanks.....;) , not been in this actual situation with other claims before, this is a new one on me but any advice/info would be a great help, thanks so much again.;)

Homer_J is the man to talk to there Di.
Its been suggested that my parents' Endeavour secured loan (which was taken out in July 2004, same as yours?) may be dodgy and could be overturned.
There are firms who will submit a SAR and go through all of the paperwork to check if it comes under the heading of unenforceable/voidable, then pass it to a solicitor. The solicitor takes it to court and tries to get the loan quashed.
(this is my understanding of the process, there are folk on this board who know the ins and outs of the process)

Marshallka, they do confuse don't they ?....:mad: , when did you take out this policy hun ?
I have letters like that 'non advised' but in my opinion they still had rules/points to follow advised or non advised !!!!
I think they say this to try and cover their butts hun......:mad: .
Over a month ago I won a claim of PPI with LV (Liverpool Victoria), this loan was in 2003, I had wrote to them and within 3 weeks they refunded over £1.5 which was right with the 8% interest, okay not a big claim but they did not argue and even stated it was then a 'non-advised' sale.
No quibbles with that one.
Thing is what have they got to really prove that it was sold correctly? to you - nothing in my opinion !!
Somewhere I read on the net where there is a list of rules that they should follow, and this was a non advised sale, will see if I can find it and add it here when I do come across it.;)
