    :beer:I HAVE WON, FINALLY!!!:T I GOT MY MONEY BACK FROM BARCLAYS.
    I did send my last letter to the big boss and got no reply and after 14 days i sent all documentation to F.O. and in the meantime Barclays offered me money back.
    So i am very pleased. Thank you to Martin AND to tiggrae and m.colak for all your advise.:T
    i still have 3 claims to go and they are with F.O.

    If all they are refunding is the new ppi they have maybe forgotton the interest that you have paid on this too. Its best to ask tiggrae to sort your figures but looking at your post before it looks like they are just offering the actual ppi on the second loan. How did you pay off the first loan? Was it added to the second loan and also what rebate of the ppi did they give you. You will need to be careful if they are going to offer you for missold because there are two ppi's and also the aprs and then the loan has to be restructered. You need to hold on if you can before accepting. Not many on at the moment but someone will be along to help. Sorry can't be of any more help.

    Loan taken out in November 2000 for 60 months to consolidate credit card and overdraft as per the banks recommendation at an account review. I will try to write up the full facts in the next week or so.

    Hopefully someone will learn from this information. The solicitor was writing absolutely everything down so I think that anyone taking LLoyds TSB to court for something older than 6 years should be very very cautious as Eversheds will surely be using this result to strike out every possible time barred claim.

    The impression I got was that they had purposely chosen my case to wipe the floor with me with all the legal terms and even the judge got the legal books out to check what they were discussing. I studied some law a few years ago and it was way beyond me.

    So much for not needing a solicitor for the small claims court. :rolleyes:

    Its would of made me feel so little against them too but you tried and did not give up and everyone was supporting you yeosal. Lets hope your next ones are a little better in your favour.

    The support from this site is great, but I am going to cancel the other claim as it has already cost me £210 and now they are asking £200 to be sent in with the allocation questionnaire. It is not the money really but the principle of teaching these people a lesson, and to be honest I felt pretty humiliated in that court room as I knew I was in the right.

    I am still a bit mad about it and thinking of horrible ways to get back at them. Think I will send them a Laini's SAR request just to give them a load of hassle.

    Got a complaint with the ICO as they wont give me a copy of another loan I had. :mad: :mad: :mad: . Maybe I should go to the newspapers :cool:

  • Hi all, we have a PPI which we were sort of 'forced' into - total cost of PPI without any interest is just over $7500. Its on a loan with Paragon Finance

    After we heard Martin on the Vine show we called them asking to cancel it about 6 months on (in January this year I think) and they replied with a yes. Quoting an amount for a rebate of just over £2000. I wrote them a letter based on the template here, requesting the full amount minus what we'd already paid. plus interest. They wrote back saying get stuffed. So we did the second letter and they wrote back saying get stuffed again.

    We have since taken it to the FOS and after about 6 weeks received a response saying someone has been allocated to our case and we'll hear from them as soon as possible.

    Yesterday I had a letter and a message on my phone from a compliance controller at Paragon Finance asking me to call him.
    So I called him today and he said:
    "The FOS have contacted us asking us to review this case, & although we don't feel we missold the ppi, in order to save money and time with this dragging on, I'd like to offer a compromise. So we're offering a rebate of £5200"

    So, Is he doing this because he knows that if we refuse the offer the FOS will not enforce any more than that plus interest etc etc and he can say you had your chance and refused, get stuffed. Or is he doing it because he knows the FOS will enforce a full rebate plus interest etc

    Bit of a dilema really and not sure wether to accept or not. If we do refuse the offer are we shooting ourselves in the foot or not? Bearing in mind there's nothing on paper yet and we've not heard anything concrete from the FOS.

    We got a letter from Paragon today offering full prorata refund of £8400 - result.
    However, this is a second loan (don't worry we've learnt our lesson now). We asked for additional lending and they made us consolidate.
    The original loan had PPI too and when they put the original loan with the new one they only refunded about £2000 of £7000 (we were 1 year into a 10 year term) out of the final settlement figure of the first loan.
    We're claiming that one too on the grounds we were forced in to it and its unfair rebate terms. They however are telling us to sod off with this one on the grounds that their agent/dealer or whatever - loans.co.uk sold it to us.

    Surely though the forcing thing is Paragon policy (as we know cos they made us take PPI on the second loan direct with them) so therefore they are liable.
    Also it was them who calculated the 'buyout' cost of the first loan when they consolidated it into the second one. 10% of term completed with 90% left to go at cancellation and they only refund less than 30% sounds wrong to me.

    So the point is - do we persue that one with Paragon and let the FOS finally adjudicate and hope for the best (in which case do we tell paragon to stick it again or accept the £8400 offered for one policy and fight the other one seperately) or do we accept what they've offered and fight the first PPI against loans.co.uk.

    Sorry for the waffle guys, but its getting a little deep now and a little guidance would be much appreciated

    I would say
    inform FOS you have received this letter and see i they think you are entitled to more cos it looks like an addmssion they are wrong but trying to pull a fast one in my eyes by just offering a prorata
    lets see what Tiggrae says should be your next move

    I have had my letter from FOS and it says i have been asigned an adjudicator with the FIRSTPLUS one. This is only about unfair settlement and the wage address and nothing else as i am aware. How long roughly does it take for them to end it from this point.???

    Just looked back at Laini's and it was four weeks from there for her. Mine is not the ppi as it outside their jurisdiction so i am told but at least they are looking into something for me. This wage thing is baffling. I bet they will get away with that one too.

    I do want to add to my complaint that they are maybe in with a conspiracy to send me on a wild goosechase about who sold the ppi and loan as they have referred to my "broker" as Wilmsow/Freedom (BRKWILM) in all the papers and then told me it was this Bespoke thing. Its misleading me and they did just as much in that respect. It is in fact LYING and if i can prove that then how much more have they lied about.
