    Evening again,
    Using the template letter to loans.co.uk, do I just use the section that states they have already been fined by the FSA for mis-selling, or do I need to add any other sentences in? Sorry to be a pest

    Dear Sir or Madam,

    I purchased the above policy from you in [insert date] but now believe that I was mis-sold this policy for the following reason:


    This is due to the fact that you have been fined by the FSA for failing to treat your customers fairly when selling Payment Protection Insurance and I do not believe that my policy was sold in my best interests.


    Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

    I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

    I'd add it abit about exactly why you feel that you personally have been nis-sold as well as the fined section.

    Hi

    I only asked for credit card charges at the time I wrote the letter - I am still waiting for them even though they have exceeded 40 days :(

    As my PPI claim is with the FOS I think I will just wait to hear from them and concentrate on the charges for now!

    If you have proof of delivery for your SAR that shows they have exceeded 40 days, you can either call them with strong reminder or write to ICO. The Information Commissioner will then deal with it for you (more waiting I know :rolleyes: ). Let me know what happens. :D

    My other arguements aould be that the laon was over 300 months :eek: , but the PPI was only over 60 months paying a maximum of 12 months payments. Do you think I should include this as part of my letter. Also I get 2 years sickness pay & also 2 years death benefit from work.

    Yes as I believe the time part is not considered acceptable in the FSA 'findings'.
    I'm sure somebody more knowledgable about these things could confirm that or not but can't see how it would do any harm to mention it then it's in writing incase you need to take things further.

    Today, I’ve received a letter from the FOS regarding my HBOS PPI reclaim. I am delighted to tell you that HBOS have offered to refund all my payments with 8% interest (a goodwill gesture :rotfl: ). I will need to have the smile surgically removed from my face!

    I am advised that once the acceptance is returned the payment should be sent to me within "around a month". Once I have the payment I will post the whole story on the success board. I reckon this should be over £1,800 which ain't small money. I'd like to mention thanks to not just the experts such as MColak and Tiggrae, but all reclaimers who I've learnt a huge amount from. Everyone has their own circumstances and has to build a case around them by putting in the effort to understand your reclaim- look no further than the highly tenacious Marshallka! :T . Finally, my biggest thank you goes to Martin Lewis who made this possible. Please don't underestimate what it means to put this kind of money back into our pockets. Your work really is appreciated sir!
