    The Halifax have certainly lodged their defence which is certainly frustrating as, nevermind that I think I have a case, but I think they've behaved abysmally in this. They have sent a dubious application form rather than a CCA, the mail that has come from their customer relations people and CEO's Office has been contemptious and cursory to say the least and certainly not how I think a customer should be treated. I have paid £1.6K for a product which didn't provide protection when I needed it, and as a result they were phoning me 4 or 5 times a day asking for payments which would not have been an issue had the blinkin' PPI coevr been sufficient! :p I ended up on mediction for stress and panic attacks shortly thereafter.

    I'd have rather settled by now, but they seem to want to challenge me all the way so challenge them I will. And if they lose I'll be taking it straight to the FSA and asking for to take their own action against the Halifax for mis-selling. I think it's a big risk for them for the sake of £1.6K of premiums, but it's in their hands now.
    Almost debt-free, but certainly even with the Banks!

    Hello I'm sorry this post isn't relevant to the topic but all of you have been so kind with your advice I though I would have a go at asking you lot! :D

    I received a letter from MINT yesterday with a cheque enclosed for £16 - they say this for the difference for the two £20 charges incured on my account before April 2006.

    I did ask for £88.00 charges plus £13.61 interest = £101.61

    They are saying that the £12 charges are fair and in line with the Office of Fair Trading Standards.

    I really want to try and get the rest of the money back but I am a bit stuck. :confused: I can't find a template letter for this stage!

    Does anybody have any advice??

    I will bank this £16 tomorrow - at least I've got something back! :T

    Total = £77,354.24

    c)Difference between a and b = £14,796.44
    8% interest on £14,796.44 = £591.85

My expectation is that you'll find it easier to reclaim the credit card charges than the PPI. However, don't be put off!     I only asked for credit card charges at the time I wrote the letter - I am still waiting for them even though they have exceeded 40 days :(

    As my PPI claim is with the FOS I think I will just wait to hear from them and concentrate on the charges for now!

    I haven't sent a letter yet - I am being patient :) as they may be taking the 40 day response from the date of my second letter which included the cheque - that was 31st May so I will wait at least another week. If I haven't had a reply I will give them a call!

    you need to start court proceedings - MINT always pay up - go onto the Bank Charges reclaim for a template of the County Court claim form - use the on-line service MCOL (money claim on line) it's cheaper and I can guarentee they'll pay up

    I have now sent my letter to Freedom and a copy to Bespoke (slightly different to the one posted on here) and have to await their response. Tiggrae, i know you think it won't alter things but i have to try. I won't go down without a fight (a bit like michael gomez during the amir khan fight last saturday:D ) I will fight for something i believe in. I am now wondering if this was a set up and FIrstplus are also involved. They have to know something too. It all started with them telling me about this company and she was very stuttery when doing it. If this is the case then all three companies want their licences revoked. These are people we put our trust in to look after our finances and our finances are part of our lives especially when your house if involved.:mad:

    Couldn't agree more, unfortunately they all know that time is on their side, after 8 years any court proceedings they can reject out of hand simply due to the time issue - it then becomes not a case of right or wrong just who knows what the law says

    might have asked this question before, but why did you start court proceedings rather than take your complaint to the Financial Ombudsman???

    Thanks for getting back to me - I will have a look at mcol now. I'm a bit frightend of the thought of court proceedings as I didn't want to go down that route to be truthful. Would another letter do the trick or the FOS? I will read up on this info before I decide though!
