Laini, i was saying to my husband this morning why i like this thread so much in that we are all in the same position or we wouldn't of gone to these sharks in the first place.

Tiggrae, if a loan is sold by someone without a cc licence would it have made it sold to me by an unlicenced any old tom !!!!!! or harry and therefore i would be due compensation from Firstplus for allowing it. Or would i be due compensation from Bespoke/Freedom for this. If it was that they were not licenced by the cca to sell finance (Bespoke/Karacus) then who would i take to court. Surely Firstplus also have an obligation. I am only speculating here and will find out on monday but just wondered. If it was that they were selling it to us like that (not that i believe they ever had anything to do with it and are only trying to wriggle out of the claims bit) but this could work in our favour in the end. They will now have to hope that they held this licence and if they did not then i am going for the loan as well and i certainly would risk the money for the courts.

don't do anything - that way if the FOS don't uphold your claim you can still go back and accept their offer

Cheers mate, I rather thought that'd be the answer. I did the maths and the prorata figure offered is the full cost of the insurance from when we requested cancellation to the end of the term. so if the worst comes to the worst that's not bad. the 8% statutory would be nice but beggars can't be choosers eh?.
If the FOS don't uphold then as you say we've got the offer (and there's no time limit mentioned in the letter either so they'd have to give it) from paragon, and we'll start the process again for the other premium with loans.co.uk.

It's just a pain waiting to be assigned an adjudicator from the FOS. We got a letter this week saying sorry for the delay, we're snowed under etc etc.
anyhoo. thanks again guys. especially Tiggrae

I had a letter this morning to say the FOS have upheld my complaint, and Halifax have to pay back all PPI premiums, plus interest, plus 8%

    :j :j :j :j :j :j :j :j :j :j

Well done!!! They've been stubborn with me so far, but if I had a success like yours, I'd have just as many smileys too :D
Almost debt-free, but certainly even with the Banks!

My neighbours who can neither read or write and are slightly backward,, took out a Lloyds TSB loan 3 years ago for £16,000, on a 6 year loan, they are paying £520 per month, this seems a hell of a lot over 6 years, there is obviously something very fishy about this, l am looking into it for them, they were never given any paperwork either.
    ps they are both retired.
