    Hi, that letter is really a bit personal to my particular claim and not really applicable to anyone elses. Glad you bought it up though. Makes me want to fight all the more and not give up... Just don't know where to turn though myself now...

    It is mine Di from April time but its very personal to my particular claim and not really one for anyone esle to use.:confused:

    ALso sent it to Firstplus as tiggrae advised under section 56 and 75 and got it thrown back to me saying that this only applied to credit cards and not consumer credit which is total crap... FOS did nothing about that either. They are a waste of time really.

    Read the letter Di cause that one I did and tiggrae added some bits for me said it all. This is my complaint...but cannot go anywhere with it and I have documented evidence of the LOT.

    That is !!!!, so sorry you are having these problems. They are all hiding behind paperwork. Please consider the unmentionables if you have exhausted every other avenue. How dare they get away with this see LLOYDS name comes up again:rolleyes:
    Not trying to sell it cause cannot at mom give full feedback as just about to go to court I think.:eek:

    Thanks Maxdp. May be needing it soon. I just feel so blummin mad at the system now. Its stinks. Have you read the long letter above that someone has pulled up from April of this year when i first started making my claim. I am so glad that someone had bought this up as this has now given me a little bit more of a fight.

    Marshallkea I am confused! When you settled the loan you got a small rebate of the PPI back which was taken off the settlement figure ? And you want a bigger rebate?

    Isnt that down to your lender who gives you that figure?

    Or am I totally barking up the wrong tree?

    I got told today by the FOS that this complaint for unfair rebate of the policy has to be made to the whoever underwrote the insurance.


    and issues relating to rebate payments should be directed to the insurance company who underwrote the policy. I therefore suggest that you initially contact the insurance company as they provided the rebate, in order to raise your concerns with it. Details of the insurance company should be stated in your policy booklet.
    The complaint handling procedures which are laid down by the Financial Services Authority, state that a business must be provided eight weeks from date the complaint is received, so that it has the opportunity to ‘put things right’, and investigate the complaint. The insurance company should therefore have eight weeks from date of receipt of your letter to look into the complaint and issue its final response letter on the matter. Consequently, if after receipt of its final response letter, you remain dissatisfied with the outcome of its investigations, you should contact us within six months from the date of its letter to refer your complaint to us.

    On the basis that Firstplus are not responsible for the unfair rebate issues relating to your PPI policy, it would be inappropriate for me to investigate a complaint against it, and for that reason I will move to close the complaint unless I hear from you with any further comments that you feel would make a significant difference to the outcome by 6 November 2008.


    Thing here is i never had a policy booklet and also the one that they sent with the SAR has no address and also is a consortium of insurers....

    So are you taking this to court now cause it sounds as though FOS are not playing ball:confused: I do not understand what they are saying about the unfair settlement surely that is with the lender not the PPI
    I wonder if the rebate is so unfair cause of the money they have paid to the Insurance Provider as commission:rolleyes: Otherwise surely unfair rebate goes back to the Loan Provider not the Insurance Provider:confused:
