But then what does this come under with the jurisdiction of the FOS and what dates actually matter here. Is the sale date or the settlement date. ALso is it an insurance complaint or a consumer complaint under unfair terms.

Are you complaining about how sold - or the rebate?
If just the rebate then complain against FP as insurance complaint. Consider though that I understand FP have had some success on "rebate" complaints since policies taken in mid 2006 (I think they altered their terms). [FP insurance is actually provided by Barlcays Insurance - but complaint re FP]

If you complain about how sold then should go to the broker that advised you.

I would contact they guy from the FOS about this, and see what he has to say, think I added his link last week on here.

But another thought, what about the FLA ? If you have not tried already that is ?

Di, this has been going on since april and I have contacted every single contact I can.

I am really annoyed at the FOS. They are so biased toward the company in my eyes.

It seems to me they have a thing against me here in that every one else gets their complaints looked into and mine is not even condsidered. I know of people on here that have had complaints about unfair rebates looked into and yet mine is thrown back. again and again. Its so wrong here. I have a legitimate claim and WAS unfairly robbed of this money by FIRSTPLUS. I cannot believe they are allowed to get away with this.

I wonder what tiggrae will say when she returns now about unfair rebates. I have it in writing here that unfair rebates are complaints agains the insurance underwriters. I think the underwriters of the ones that are being looked at now against FIrstplus were Barclays themselves and they changed to these in 2006. Mine was prior to this and also I note that although I put 2003 as my complaint date it was the date of sale that singlep said it was that mattered as they have written this in the letter as they have said it was 2000..

Also if it is the actual sale date that matters for unfair rebates then do the underwriters have to have been under the GISC or whatever at the time of the sale as this would again be a jurisidiction thing.

It would be just like the brokers.... if they were members of the GISC if it was pre 2005 ????

how do I go about working out the total cash I have paid+interest+8% interest for any claim that I might be succesful on.

I am claiming on 3 loans I have had with RBS, one in 2002 which last 2 years and my PPI was £28 a month, 2004 and only last 1 year and my ppi was £36 a month and my last one was 2005 and I paid this for nearly 2 years and ppi per month was £65.

Going on the first I probably roughly paid £700 to the protection, the next roughly 500 and last one 1200. Is that right if so how do I then go on to calculate the interest+the 8% interest?

Like I said earlier, I can't get my head around this, and if they can look at others in the same situation then there is something wrong if they are unable to look at yours, it does not seem right !!
Especially if it were the same company as yours and more or less the same dates......

This was a manager today so I can;t see anyone at the FOS being able to help me now. I think they have discriminated against me basically cause I have resubmitted and gone against their decision. They do accept these types of complaints and it is against the lender and not the broker and everyone esle, tiggrae, troness etc says the same but suddenly they have changed this just for me. My annoyance has now turned to sadness at the whole system. It stinks....

    Hi there
I would get some reclaim letters in and also request for copies of the written breakdowns in a separate letter, check out the above link "reclaim £1'000's" and on there you will come across some mis selling information and the template letter is also on that link, they have 8 weeks to respond.

Write as much as possible to back you case, keep at them.;)

If your unable to find the template link let us know.

You do not need to add the figures to your reclaim at this point hunni good luck !

They are NOT allowed to discriminate you, something has gone amiss here on their part and they have gone wrong.........AGAIN !!

I would not leave that there !

I have been trying to find that link I added here before, this guy is the one that considers these complaints, he is over them again to my knowledge and I can't for the life of me find it now !!!

Your situation can be explained, then its not down to the adjudicators manager, it will be down to this guy if he thinks they should look at this !

Mine was settled in 2003 and I know that they did change insurers sometime. (I think it was 2006). I have had thoughts about this and whether cause it was changed to barclays insurance then them complaints are able to be looked at but mine was 2003 and still with the other insurers but again, no-one was told to make the complaint against the insurers in the first place. Catinthehat is in the same position and also Anna jade and they are passed through.... Its just me. Laini was about unfair rebate too...
