Just made sure with Endeavours insurers just in case, it seems they were covered as from 2001 here:

I feel like they are definately on the side of Firstplus here. I told her I know of people that have sent in complaints about unfair rebates with Firstplus and the Ombudsman complaints service are looking into these. She said that they would not be able to with mine and she could not comment on others. She also said that each case goes on "merits" and mine did not pass. She would not tell me why but did say that unfair rebates are ALWAYS against the underwriters of the polices and not with the lenders. I stated that she was wrong and she said that it was definately the case. She then asked me about the actual agreement and whether I had the original one. I told her again that FIrstplus had sent this to me but only the front as the back terms and conditions were not scanned in so they sent them seperate.0 -

I am baffled here too because when I wrote to the FOS about the unfair rebate, she added on the form "Endeavour" as a "New complaint" and the date of NOV 2005, this was down to them and not us !
I enclosed a copy of that letter they sent me to say they may be able to look into this, okay please note "may be able to" and I can see mine coming back to me too, so I have a good mind to get back to them and find out before this goes any further !
And if I am to pursue to the insurers I will do that but need to know now and not later !!!

Yes I remember.
Something not right ........cannot get my head around it, and I know I did not know anything about unfair rebates before and only recently, but I am sure the calculations are done by that of the calculation department of that loan company.
The insurers is the ones who pay out if a claim. where the loan company pay the ppi money in a lump sum at the start of the loan as you know, but the loan company were taking your payments from you so whereas at the end they deal with the calculations, where the insurers can deny any responsibility with this !!!The one and only "Dizzy Di"0 -

Re your issues with Companies like Freedom and Click (Brokers)... you need to establish:
who sold you the loan
who underwrites the loan
who sold / advised you on the insurance (if an advised sale)
who underwrites the insurance.
To advise/sell insurance in the uk - they must be regulated with FSA. Freedom Finance are indeed regulated. Basically if your complaint is about "how" the product was sold then it sits with the Broker.
If the complaint is about the product itself ('the what') then complaint normally to the insurance providers (normally the lender or lenders insurers).
Re Sec 75 claims - this does not cover the Broker/Lender/Insurer relationship as some here seem to be trying to ascertain. Unless the broker is also an appointed rep of the lender - then its the brokers responsibility to comply with their own regulated requirements. When dealing with Brokers - bare in mind that they are YOUR agents and owe you a fiduciary duty.0 -

See if its back to Click then I do have a problem here, Hamilton were the insurers of Endeavour the lender, and the rebate was made by Endeavour, because we had to contact these for the figure, it was then sent in the post by the lenders.
If it were mis selling then I would take it that would be the broker as they arranged the loan but they did not calculate the rebate at the end of the loan......have I missed the point here ?The one and only "Dizzy Di"0 -

But then what does this come under with the jurisdiction of the FOS and what dates actually matter here. Is the sale date or the settlement date. ALso is it an insurance complaint or a consumer complaint under unfair terms.
Are you complaining about how sold - or the rebate?
If just the rebate then complain against FP as insurance complaint. Consider though that I understand FP have had some success on "rebate" complaints since policies taken in mid 2006 (I think they altered their terms). [FP insurance is actually provided by Barlcays Insurance - but complaint re FP]
If you complain about how sold then should go to the broker that advised you.0
