I think the site is playing up again. Its doing my head in or its virgin again. I am calling it a night now Di but catch you tomorrow. Banging head from yesterday and then relief of today. Now I am on pins again as to the outcome. I hope I am posting good news here in a couple of weeks. I bet co-op will kick up a fuss though. How does this work from now. The adjudicator said that he would now get back to the co-op and ask them to make goodwill gestures on the other loans. Does that mean that he is not actually adjudicating yet and giving them a chance to settle without it... What happens then if they come back and say " we are not paying any more". Is that when the adjudicator then looks into the sales in more detail and then either agrees with the co-op or with me...and upholds the complaint.

Yes you have had a rough time of it lately.
I'm not surprised with how your feeling hunni.

I do think your adjudicator will give them a chance to put this right first and let you know what they come up with, I would give him maybe a week or 2, and request for an update because I think by now he would have prepared for this.
If they (co-op) are not happy they will say to send this on to be further investigated by another member of the FOS, although i do think they will pay up all now after they have offered on that one already, but you then have to agree or disagree.
You may want this to be looked at again if your not happy, where this then will be moved on again either to another adjudicator or the ombudsman himself.

I think you will be okay though hun and I feel the adjudicator will back you with all these now.;)

We will keep everything crossed hun.;)

Try to have a good nights kip then hun and I will catch you tomorrow.:A

    Night hun sleep well.

    Hi again

I've looked it up a bit more and it appears that mortgage payment protection insurance is similar to the normal PPI but it doesn't usually include the life element. If you only found out about the lack of life insurance in 2004, then, I believe, the six years you have to claim should start when you discovered it. Speak to someone from Citizens Advice or a solicitor as I said in my earlier post as they will be able to let you know if anything can be done. I hope it can.

Thank you so much for taking the time to look things up for me. I am going to see the CAB next week.

So by saying this then Di, does that mean if they do not offer goodwills on this then another adjuducator takes it on

If they (co-op) are not happy they will say to send this on to be further investigated by another member of the FOS.

So my new adjudicator is not the one who will adjudicate this then:confused: .

Hopefully it will be settled with this adjudicator.

Now with mine because nemo were not having it, it went then straight to the ombudsman from the adjudicator, yet Laini's as you know went from one adjudicator to another which I did actually think at the time she must have meant the ombudsman.

The loan company if they are not happy and do not resolve this for you at this stage they may suggest for this to be looked at again, it is then at that stage it is moved on if the first one (adjudicator) cannot do so themselves and they have done all they can do.

But if this adjudicator agrees with you now at this stage he can request them to now uphold the complaint and to refund you with all 4 loans.

So he will have to wait for their decision on this and I do think they do then give them a few weeks to get back with a response to this, he will then let you know what they say, and take it from there really.

You adjudicator should now keep you informed and up to date of the full process of this, so as soon as he hears he should let you know.;)

I'm sure he won't mind you keeping in touch now hun anytime, so maybe you can always ask him to send you a copy by email of what he is sending in writing to the CO-OP.
I think he can do this for you.

Yeah but Di, with yours and Laini's they were both upheld by your first adjudicator and then the company disagreed so that is why that has happened. Mine has not been upheld by anyone yet has it... I have not been informed of this. All he says is that he will give them the chance to settle these by gooodwill. I think then this adjudicator will either tell them to settle and uphold the complaint (Not by goodwill) or agree with the bank and tell me on my bike. I can't see that it will go anywhere yet as nothing has been upheld. He has only given them a chance to settle without the need for this.

Yes hun that is what I mean, he will try first and if this does not work out where for example he wanted to uphold yours but the loan company did not agree to this, then it would be still classed as upheld then moved on.;)

Now if this first adjudicator upholds this complaint, it will be passed on to get investigated again where normally the next one the ombudsman then is very likely to stick with the adjudicator decision.;)

You still have every chance of getting this resolved with the first adjudicator, with a bit of luck it will be.

Its only if it becomes more complicated really that its just moved on to the ombudsman himself, and I do feel yours will be resolved with the adjudicator you have now, so no moving on to anyone else then.

He has not even started to uphold this yet as he is trying by goodwill and without them admitting anything. I think then he gets involved deeper and looks into it in that he either upholds them or not. If he upholds them then co-op would more than most likely pay up. If they do not then it goes to another adjudicator or the ombudsman. That is what i thought. I cannot believe that if they don't settle by goodwill now then it goes to someone esle. Surely he can do the upholding or not upholding first as he has not done anything yet only given them the chance of settling without admitting misselling.
