Yeah, if you are working 16 hours or more it is classed as full time work. If at the time you were working more than 16 hours but lost to anything under 16 then you would have been ok to claim.

ok let me try and work this out - i am not able to make a claim because i still work 16 hours even after losing my main job - so therefore the PPI is useless to me at this time.
But was it missold to me??? I have already had a reply from lloyds on the first letter which i went down the route of the PPI being missold on the grounds that it was never optional, i was told unless i took the PPI the loan would be delicened as i was high risk. LLoyds have written saying this wasnt the case and that lloyds did not lead customers to beleive that the insurance was compulsary or that the application would be comprimised in the absence of cover and through its processes, practices and documents took steps to ensure the customer was fully aware of the optional cover blah blah blah we would welcome any new evidence i can provide.

    so there word against mine????

To state your claim against the PPI on the point of you not being able to claim cause you lost your self employed job but carried on 16 hours would not make it valid.

To say that it was not optional to you would make it a valid claim. You just write back again as this is the standard fob off and reiterate the complaint but don't make much of the 16 hour thing. I would then let them give you a final respone or uphold the complaint. Once you have a final response you can then take the complaint to the FOS.

Most things have the 16 hour rule. If you originally worked 100 hours and then cut down to 16 it would still be classed as full time employment even though you have taken a drastic cut in earnings. You cannot claim benefits for unemployment if you work a total of 16 hours and this is how these policies work. On Tax credits for instance you would get the working part of tax credits for any work of 16 hours or more. If you only work 15 you cannot claim this part.

When was this PPI taken out???

I think the site is playing up again. Its doing my head in or its virgin again. I am calling it a night now Di but catch you tomorrow. Banging head from yesterday and then relief of today. Now I am on pins again as to the outcome. I hope I am posting good news here in a couple of weeks. I bet co-op will kick up a fuss though. How does this work from now. The adjudicator said that he would now get back to the co-op and ask them to make goodwill gestures on the other loans. Does that mean that he is not actually adjudicating yet and giving them a chance to settle without it... What happens then if they come back and say " we are not paying any more". Is that when the adjudicator then looks into the sales in more detail and then either agrees with the co-op or with me...and upholds the complaint.

I hope you win too Di. My new adjudicator has been there both days on the trot and is really friendly too. He did not mind me calling him at all.
