PPI Reclaiming discussion Part II

I thought that I would post an update as to my PPI reclaiming.
Paragon Loan Via e-loans.co.uk (broker) – I am in the process of reclaiming my PPI. At first I contact e-loans as they were the broker but later found out they have gone into liquidation (I have sent a letter to the company dealing with this for my information). So I sent off a SAR via Loancheck to Paragon who I have my loan with. As the 40 days were up I call Paragon myself and found out from the head of compliance that they wrote a letter to Loancheck advising they will not send any information out regarding my account because they are getting too many SAR forms and feel that companies like loancheck are asking for information that is not entitled to them. I pointed out that the SAR was sent with my consent, he then asked why I want this information. I told him it really does not matter why I need the info, I am entitled by law to have it. He backtracked and said that he will send me information but later added that I won’t be getting information on commissions. I think Paragon have over stepped the mark on this because I called Loancheck and they said that never received a letter from Paragon advising that they will not send this information to them and the reasons why. As far as Loancheck were concerned they we still awaiting the information. I think Paragon lied about sending out the letter and because I called them and told him my rights under the Data Protection Act he said that I will get this information – I have not as yet. Should I complain about them to ico.gov.uk??? I feel from the conversation I had from Paragon’s head of compliance that he was talking rubbish saying that people are bending the rules of the Data Protection Act and companies like loancheck are pebble dashing banks. I really could not believe that I was hearing this; surely this is against the rules?? It makes me think something is not right with my loan as well as the PPI.
Also I managed to get my information from HSBC regarding my loans without giving up £10, which is good. HSBC are normally quite good giving me the information but not so helpful when I ask for my money back. I have now sent a letter regarding the PPI and I am waiting to hear back – so fingers crossed.
Loancheck should be dealing with this now, have they said what they will do next? Paragon sound like they are running scared!DS1 12/10/04

Well i spoke to loancheck and they said that i should see if i get the information by the end of the week, if i do i should send everything to them and they will allocate a panel of people who will look at what is sent, i guess that we be able to see that there is anything missing.
What if i don't hear back from Paragon, is it me are Loancheck who complains?0 -
You are right, it does seem that something is not right here. I have had dealings with Paragon when i ask for certain information and they have not sent it or sent me something wrong. They hate having to explain anything to you and are very aggresive.

Hi there Parrot, sorry to miss you but right now I have my case of Eloan with the FSCS, these were twopart eloan, this was taken out in nov 2005, I will re-read your case now shortly but you do really need to contact the financial compensation scheme in order for them to deal with your case and the liquidators who are Begbies and Traynor.;)The one and only "Dizzy Di"0 -

I already sent in copies of the agreements and also emailed them before. I have now got to email them again but as yet having trouble.
My original complaint had the very last loan we had on the complaint form but I mentioned that we had four with them in all and could they look into the others too. I then had a phone call from the adjudicator to say that they would most probably and then he went off sick.
Yesterday I called again and was told that he never returned to work so they would allocate another and that my emails were there but nothing down with them. Today I have received this stating that co-op have made this goodwill offer to me but not for the all loans, they have just picked the lowest one and offered that. I have today told the adjudicator that I would not accept this and that I want all four loans looking into. He said he would get back to the co-op on this if I could send him copies of all agreements. (I already did to the other adjudicator). I feel so confused here.
Yes I admit this is very confusing
Hope the adjudicator gets back with some better news for you hun, you have worked very hard throughout this case. The one and only "Dizzy Di"0 -

I really think it will be straightforward from here, once they have the agreements.DS1 12/10/04

Hey there,
Well i have already approcched the financial compensation scheme and was told they can't help me because it was pre 2005. I took my loan out in 2004. It seems that i am going nowhere fast because was told by FCS to fund out who the professional indemnity insurers are and claim through them. Whe i spoke to Begbies they had not clue as to how i would reclaim the PPI back.:mad:0 -
Parrot
Eloan.co.uk were the brokers who arranged my loan in Nov 2005, (twopart are them), these went into liquidation in May 2008 this year.
The financial compensation scheme will deal with these for you if these were the brokers who arranged your loan and as I mentioned above you will need to register your claim with the FSCS and with the liquidators as I was informed to do this.
I have been informed by the FSCS that they are now investigating this company, but at what stage I do not know as they never disclose much.
Here are the details of the FSCS, contact them hun if eloan arranged your loan.;)
http://www.fscs.org.uk/contacts/
I would email them also, the more complaints the better.;)
Good luck, if you require further information please just yell.

Just contacted HFC complaints department as today is the 40th business day from the date my complaint was raised, still no update 'citing' they have been unable to retrieve my original documentation.
Although the person I spoke was very apologetic, it's very poor customer service in my opinion. We use the same off-site storage company, so I know exactly how long it takes to retrieve information (they're basically not telling the truth or haven't bothered to request it).
Onbudsman letter to be sent later today, with a request for additional compensation.
Wish me luck!0 -

Loancheck should complain as they are the ones you have authorised to deal with it. I am sure they will tell you, if you have nothing by the end of the week.DS1 12/10/04

Oops sorry Parrot I just noticed we had posted the same time as above....:o .
Damn....... , right then okay, lets see what else there can be done then, now over a fortnight ago I decided to again contact the liquidators and out of curiosity I were told that another company had taken over them called "Essex county Loans Limited", but unfortunately they have just recently liquidated too - according to what Begbies and Traynor said, now these liquidators can surely provide you with a claim form as they did with me, I'm not saying we will get anything out of them but surely you should have the same rights here, whether it was sold to you prior to 2005 or not.
Give them another call and tell them you were a customer to these and if they could send you a claim form, tell them you are aware that other customers have received these forms.
I would just try hun and give it another go.
Please keep me posted, thanks.;)
Even though I have a form in to the liquidators, the FSCS has informed me to do this but still keep my case on file, because its rare the liquidators pay out to my knowledge.
But if you have other options then I would go for them, like what the FSCS said, or maybe contact the FSA, they may be able to advise you.
Have you settled the loan ?
And if so were you happy with the rebate they reduced ?
If not because it would be the lender and not the broker here, you could always try to complain to the actual lender about the unfair rebate you received instead, its just another option but maybe worth your while if no other way round the brokers.;)The one and only "Dizzy Di"0
