Just contacted HFC complaints department as today is the 40th business day from the date my complaint was raised, still no update 'citing' they have been unable to retrieve my original documentation.

Although the person I spoke was very apologetic, it's very poor customer service in my opinion. We use the same off-site storage company, so I know exactly how long it takes to retrieve information (they're basically not telling the truth or haven't bothered to request it).

Onbudsman letter to be sent later today, with a request for additional compensation.

    Wish me luck! ;)

Wow, the very best of luck hun, keep us posted.:D ;) .

  • Hi everyone

I want to be able to reclaim PPI on a First plus secured loan we took out almost 3 years ago (beginning of 2006 I think), it was paid off when we sold and moved in March this year.

Unfortunately I don't have my loan documents anymore so don't know where to start, the loan was for £20k and the PPI added to this was another £5k, I want to reclaim it because I was led to believe the PPI covered the term of the loan (20 years) but then discovered afterwards that it was only the first 5 years, plus both me and my husband have good jobs where we would be paid for the first year of being sick anyway

Can anyone help to explain where I start?

Oops sorry Parrot I just noticed we had posted the same time as above....:o .

Damn....... , right then okay, lets see what else there can be done then, now over a fortnight ago I decided to again contact the liquidators and out of curiosity I were told that another company had taken over them called "Essex county Loans Limited", but unfortunately they have just recently liquidated too - according to what Begbies and Traynor said, now these liquidators can surely provide you with a claim form as they did with me, I'm not saying we will get anything out of them but surely you should have the same rights here, whether it was sold to you prior to 2005 or not.

Give them another call and tell them you were a customer to these and if they could send you a claim form, tell them you are aware that other customers have received these forms.

I would just try hun and give it another go.
    Please keep me posted, thanks.;)

Have you settled the loan ?
And if so were you happy with the rebate they reduced ?

If not because it would be the lender and not the broker here, you could always try to complain to the actual lender about the unfair rebate you received instead, its just another option but maybe worth your while if no other way round the brokers.;)

I have given them a call but they guy who deals with Twopart is at lunch. The problem is the loan has not been paid off (wish it was). As per my post before i have, with the help of Loancheck sent an SAR form to Paragon (the people that i have a loan with via e-loan) but i hit a brick wall there because the head of compliance admitted to me over the phone he was not going to send out the info regardless of the Data Protection Act. Also he said that anything to do with e-loans id not there concern and they no info on them. Yet the way he was with me regarding information on my account got me to thinking that there maybe something up with the loan too. So i am going to pursue that further - nothing to lose and all that.

At the end of the day i am owed money back it jsut hard trying to pin down who i go through because no one seems to want to help.

That is why it's great having the help here.

Hi there and you should be okay with this one then.;)

Get a complaint/reclaim letter into them, and this link here should help you decide what you want to add to your letter, and if not done so already check out the template letter link on this site below, and try to put it into your own words if you can, keep the letter strong and they have 8 weeks to reply to you, check it all out here.

And good luck, please keep us posted in order to move on to the following step if we have to, cheers.;)

First just ring up Firstplus or write to them to ask for a copy of the agreement - or just send in a complaint without the agreement and they should find it all from their records. Tiggrae always says that for loans since 2005 so you should be ok doing this. Still get the copy agreement but you do not have to wait for it before sending in your complaint. Its up to you.

Look at the template letter on here and then add/delete whatever is appropiate to your misselling here. I have got a complaint with them myself and noted that they wrote on records "template letter for PPI complaint" so I would try and make a letter yourself from this.

You then have to give them 8 weeks for a full and final response to this. Send it recorded delivery so you have a proof of this.

And yes you go for it hun, its your money and we want you to get this back.

I would contact the ICO about this, something is not right here hun, so check this out and they should supply you with the SAR as requested !

This is how I had found out that Twopart/Eloan had gone into voluntary liquidation, I had requested a SAR, then a few weeks on I received a letter from their liquidators whom returned my £10 cheque back and said an SAR will not be sent because the company are no longer running due to them going into liquidation, I was so annoyed about this and was never informed until about 2/3 weeks ago when I rang the liquidators that Essex county loans had taken over from them and they have too liquidated now !!!

I know how you feel in this respect, as I am also dealing with another firm who dissolved in 2006, my problem there was like yours, I had taken out a loan in July 2004 and they were not covered (Click finance), yet this company has many companies ongoing now and same directors who will not take any responsibility, and the company that did dissolve had the same-ish name and used by the same director now..... , this is another story but will not go back into details about that one right now..... .

I do hope something is sorted for you here hun, please whatever you decide to do let us know, and maybe others here can made some suggestions for you also.;)

Have now managed to email all the agreements to the new adjudicator and he said he would get back to me to say he had received them.

I have a bad feeling now with this one. I don't seem to win any of mine. The new adjudicator said this morning that he would get in touch with the co-op and ask for all the loans to be taken into consideration. I feel that they are definately going to kick up a fuss here. I will just have to kick up one back or does the adjudicator do that for me. I thought the whole point of the adjudicator is to come to a decision of if it is missold or not:confused: . And if it was then they intruct them to pay the lot back and the statutory interest if you have asked for it. I cannot believe that this has happened. Its the fault of the other adjudicator going off sick and then leaving his work for over 5 weeks and nothing being done. Its just not right. I have now got to wait for this one to be started up again. He said that he needed a final response off the co-op to the other loans. I told him that they have had well over 8 weeks to respond to them and have not. They are now giving them more time. Again, the bank takes the reins.

I do hope they look at the others but they with them requesting for the other agreements then they must be hoping to look into them for you, as they were already aware of the dates wasn't they ? of all the loans ?

Its agonising isn't it? more waiting.....

With my very first complaint, (Nemo) I knew hardly a thing of how these complaints worked then or anything about requesting the Stat interest, but I had this anyway, because my Adjudicator and ombudsman said they should pay this anyway, as it is what a court would award, I did not request it because i knew nothing of this then.

  • icon1.gifShould I cancel PPI now?
HELP! I am in the process of reclaiming PPI on 2 loans through a solicitor, should I cancel the PPI now or will this interfere with the claim. I have been told the claim could take up to 2 years. I don't really want to keep paying the PPI for the next two years knowing I don't really need it. Should I cancel it now?
