Have my Lloyds PPI with solicitors at moment and just to inform you this is what they have asked LLoyds for
Breaches of the CCA 1974
The agreement does not comply with the terms of the CCA 74 in that
It does not contain all of the prescribed terms and therefore does not comply with section 60 .
It does not contain a clear statement of the amount and rate of the "total charge for credit" and therefore does not comply with section 20 and or the Consumer Credit (Total charge for credit) regulations 1980.
Commission on the Business Loan Repayment Insurance was not disclosed to the borrower.
The Business Loan repayment insurance was mis-sold and cover was paid as a lump sum upon drawdown of the loan.
Consequences of breaches of CCA 1974
As a result of the above detailed breaches of CCA 74 agreement is an improperly executed agreement and is therefore unenforceable by you against our client by virtue of section 127 of CCA 74
Lack of CCA Licence - Please provide proof that a valid consumer credit act licence was held at the time of entering into the agreement, as required by section 21 of the cca 74.
As a result of the lack of consumer credit act licence the agreement is unenforceable by you against our client.
Undisclosed commission( blah blah) This constitutes a payment of an undisclosed commission and is therefore a breach of the law of agency.
You may be able to use this in your letters if you want more info on this let me know:D:mad:0 -

Thanks for asking about my Daniel, he is doing okay today thanks hun, and eating too, so that's a good sign - okay not eating a great deal but its a start......:D. I am spoiling him.....:o lol.

Hi Di & Marshallka, thanx for the info earlier about SAR's & DMP.
On another note just wanted to get some advice about my complaints with Welcome x 3. My adjudicator has been in touch asking for more information about my loans in relation to PPI. As 2 of my loans were initially referred by Dial-4-a-Loan i.e Portifeld Financial Services, Welcome state that my complaint is with them as they packaged the loans and Welcome just sent out the loan agreements and documentation. My argument is that because the loans were secured on property and paid off early I had to get confimation from my employer about my earnings to qualify and meet their criteria for both loans. I did have numerous telephone communications with Welcome while the loans were being processed and was mis-sold PPI . I hope the FOS don't come back and say that my complaint is with Portfield and not Welcome. My Q is whether I will have to start the whole process over again? Any advise on the matter would be helpful to put my mind at rest.0 -
Lloyds TSB rang back up again this afternoon, to speak to hubby, because he cancelled last week and said he would call in his own time because at this present time he is on sick leave.
So the manager rang earlier, (who is female) and asked again if she can make another review appointment, he was straight with her and said "look, what can you do?, I told you last week I am on sick leave and do not have a great deal going into the account", she said "oh sorry I had forgot, but you do have my contact details, if there is anything I can do to help"......:rolleyes:
Seems strange how a letter came from them yesterday too with another loan offer......:rolleyes: , they have no chance......:mad: Cannot anyway is hubby is on the sick, surely they would not offer these if your on the sick ?:eek:The one and only "Dizzy Di"0 -

My ex husband used to tell me that he was taking my broomstick in for an MOT instead of my car:D:mad:0 -

Ask if they will let him have PPI tell them you would like it front loaded just to make it easier.:rotfl::mad:0
