Yes they have objected to it being upheld and have asked it to be re looked at..

do you think they will go to the ombudsman??
Sometimes from what i understand it goes before another adjudicator first and does not get to the stage of the ombudsman. Laini on here was in the same position and I see Di has posted and was also. I would not worry and also its often quicker than another 6 to 9 months.

I am hoping someone can help. I have recently asked for a copy of my loan agreements/paperwork from Lomard Direct (RBS) and received these 2 weeks ago. I have written to them using the template saying I have been missold as they did not tell me about the PPI when I was taking out the loan (was processed over the phone and advisor quoted amount with PPI included) The thing is I have signed the paperwork with the PPI on?? Is this going to affect my claim or do I even still have a claim?? Should I have been told about the PPI over the phone at the point of sale.

Anyway I have received a response from them today saying they are investigating and can I fill in a questionnaire in the meantime. I am not sure what to do next, whether I should fill it in, or should they have this information??

These companies will do anything to try and stop you claiming including these pathetic questionnaires. Here are the answers, that personally, I would put

    Questions are as follows:

    Personal details

Please confirm your employment status when you taken out the policy?
Please confirm your total working hours per week when you taken out the policy?
Please provide details of any existing policies that you held, or if appropriate, details of why you now feel you had no requirement for the plan?

Presumably you would have this information on application of the loan, or are you saying that you did not ask about my employment status when I applied for it?
I wasn't asked about existing policies nor offered a chance to say why I had no requirement for the plan as I DID NOT apply for the PPI.

    Your recollections

Please confirm how you applied for the policy, example through NatWest or RBS branch (please provide name of branch, over the phone or via the internet)

I did not apply for it at all

Please provide details of the loan/credit agreement, eg. Personal loan, credit card, mortgage, overdraft, etc, that the policy was taken out to protect.

    You have this information

    Type of agreement;
    Name of provider/lender;

    You have this information

    Loan account number/reference number;

    You have this information

Please provide your recollections of the description of the policy that was given to you by the seller. If you believe that the plan differs from the description given, please explain how.

Please see my letter where I stated that that the policy was never described to me

Did you provide the staff member with any details of any cover that was in place before proceeding with the application and what was the sellers response.

    They did not ask

Did the salesperson provide you with any brochures/literature regarding the policy and level of service that was being provided to you? If so, please list the titles of these documents and, if possible, please provide copies.

    No

    Complaint details

If there are any further issues that you would like this office to investigate, please detail them below.

Please provide any other information that you feel may be relevant to your claim.

Sorry for long post but any help would be appreciated.. I am claiming for approx £3000.

    Many thanks

    Dave

We have had a rebate offer that was ridiculously low and after advice from Di have written requesting the SAR report and paid the £10.00 fee.
We only have until Nov.2nd to accept the offer so do we accept this or not?
  • Hello all! I don't usually visit this part of the site so forgive me for jumping right in with me questions :D

My OH is self employed, doesn't own his own business but works for someone else. He has a loan with Halifax and ppi was included as he assumed he was covered when he couldn't meet payments, however since we were having difficulties meeting the minimum payments we assumed that this protection policy covered his payments.

I just wanted to ask if he had a chance of claiming back ppi even though it is tied in with a loan? I think this would be cheeky but after reading about ppi on several sites it seems this is a grey area and not many people have a successful claim with it anyway, making it virtually useless especially if you are self employed.

What are the first steps? request a CCA to see if the box was ticked or send a template letter? He is on a DMP too.

    thank you

    Hi again,
    Our Nemo saga continues !!
We have today received a letter from them offering us £447.41 rebate on the original premium of £5074.76. There isn't a break down of interest or anything, that's all it says.
What do we do next ?? Do we cancel now in writing and accept this even though it's a massive rip off !!
Kazc, I would not accept the rebate and continue with the misselling... Have you sent the letter off for the misselling here or not?? Are you only going for the unfair rebate here??

If the policy was not ever suitable to your needs then I would go for the misselling otherwise you are paying for this for nothing.

When was this taken out?? I would just send in the letter for the misselling and then a seperate one for the agreement. Its up to you if you wait for agreement first and want to find out if this was pre ticked or send it in anyway for the fact the policy was useless and also that it was a single premium policy and actually a loan on top of a loan which you would be paying interest on too.

Send them recorded delivery so you have a proof too.

Yikes no...... that is extremely low........considering the difference in the actual PPI.
If you sent the letter was this the response you had received from them hun ?

    Hi there,

I was just wondering if anyone has had any luck in reclaiming PPI on credit card with HFC?

I am writing to FOS to complain on mis-selling of a flexible loan(basically a credit card under a different name!) this was taken out with household bank
HFC made it seem that it was a condition of getting the loan at point of sale
They did not say that cover could be found elsewhere
They did not ask about past medical history
they did not say what would be included or omitted in the insurance
their was no option to not have the insurance there was a pre ticked box
they have not supplied any PPI info, documents or agreements under the FULL SAR requested

I have reclaimed Credit card PPI from Halifax but i did not have to go to FOS to reclaim

Hellooooooooo there AC hope your okay hunni....:D ;) .

Blimey what date did you request for the SAR hun ?
If well over the date complain to the ICO (Information Commissioners Office), do you know if they have debited the £10 payment out of your account AC?

I would meanwhile still send in a reclaim letter of all your reasons, you know how it goes.....:D .
When was it when you first had this HFC card hun ?

Are you going for misselling here or just for the unfair rebate and why have you requested the SAR when this was taken out since 2005?? Was this for you to know if you were missold cause i would say that you definately were missold here as you knew nothing about the policy at all from what i read?
