I have had a complaint with the ombudsman since Oct 07 re m and s money. I have an adjudicant who has advisedthat she is upholding my complaint. M and s have come back and have given her some other points to consider. Durinmg my conversation with my adjudicant she advised that unless they brought up something major that had been missed by me and her, she would keep her decision. She did advise that if they still disagree it would go to an ombudsman when it is currently taking 6-9 months to resolve!!!!
Has anyone got any advise as to what I should do, I have been told that "decent" companies hardly go to an ombudsman.
I am sick of chasing this and keep having my hopes dashed!
Any help please???Orexperience you can share.
Also can fos take as long as they want ?

I received the same questionaire from Mint Credit Card today.
I just filled in the employment hours and put I didn't request the PPI.
I was suspicious of this form and thought they might be trying to catch me out.So just kept it simple.DS1 12/10/04

Hi there.
For you to know hun, I have been there with a similar case to this, and it had taken 14 months to resolve as it became very complexed, and it went as far as the ombudsman, and the loan company kept on requesting for longer time to send in further information, but all they kept sending was the same information as they did from the start, so they basically used stalling tactics, the loan company that is.
However the ombudsman will pick up on that hun and as this issue of mis selling is becoming a big issue I am sure you will get through this.;)

Do not worry about it.
It will certainly NOT affect your claim on this, they are trying to fob you off, so write back and tell them, it was their responsibility to make sure you would be eligible for the loan/ppi and not yours as you are the customer and they should have also followed the selling guidelines.
When did you take out this loan Dave ?
And besides if you cannot recall on receiving any leaflets/brochures etc tell them you are unable to remember.
Even if you was eligible for the ppi it did not mean you wanted it and you may have thought it was the condition of having the loan because THEY did not tell you otherwise.
Dave do not worry hun, and I am sure there will be other responses to this here for you, keep on checking on here just in case.
Don't forget they were the sales person and not you, they should have explained the full lot to you, brochures or not.;)

I am claiming for 2 PPI policies with the same provider (Lombard Direct/RBS).
I have had two loans and they have had the cheek to apply PPI to them both without my say so. The second loan paid off the first loan as I wanted to increase my lending with them. I remember speaking to the salesperson the second time and me asking how much it would be per month, and he quoted the amount which I said was ok, but he did not tell me that figure included the PPI (and obviously would have been cheaper without the PPI). I know for a fact I would never have agreed to any PPI, and know they never mentioned it during any telephone conversation.
I am not sure whether to fill in the questionnaire, or only part complete it. I have seen another post on this site saying they returned it to them blank saying if they had sold me the PPI correctly in the first place, they would know all these details. What are your thoughts on this?
Both loans were taking out over the last 5 years so I am inside the 6 year time limit. I cannot remember what brochures were sent to me. I binned all my paperwork years ago, so I requested a copy and paid my £10 a few weeks ago.
Any advice for how I word the letter, and whether the questionnaire should be completed, or which questions??

I was just wondering if anyone has had any luck in reclaiming PPI on credit card with HFC?
I am writing to FOS to complain on mis-selling of a flexible loan(basically a credit card under a different name!) this was taken out with household bank
HFC made it seem that it was a condition of getting the loan at point of sale
They did not say that cover could be found elsewhere
They did not ask about past medical history
they did not say what would be included or omitted in the insurance
their was no option to not have the insurance there was a pre ticked box
they have not supplied any PPI info, documents or agreements under the FULL SAR requested

Yes I would be inclined to do the same and tell them exactly that, they have a timescale to get back to you so don't worry to much about that form, as they did have a duty to sell this by using rules !
I assume your waiting for your SAR then at this present time ?
I am hoping they will provide the telephone recordings for this as this will come in handy if it goes as far as the FOS.
They should actually provide this if this was sold to you after 2005 because to my knowledge any phone call conversations should be recorded as from that time and provided to you on request.
I would write to them and tell them if they do not uphold and refund you your PPI you will have no choice but to take this to the ombudsman to investigate with all the evidence you have to prove this was mis sold to you.
Tell them you were not informed that the ppi was included in that amount because you did not know you were being sold this.
You need to tell them that they had rules to follow and should have mentioned the ppi and they should have made sure you were eligible and if you required this.
They should have told you that this was optional and they did not.
Add as much information as you can to explain your mis selling reasons in full, and tell them that you have not filled in the form because you cannot recall on any of it.

All I personally would do here is answer the questions on the questionaire that are applicable to YOUR claim and also state that your main reason was that this was sold to you a single premium policy with no details of the policy and most important to this that you loaned the money to pay the premium hence interest on this for the full term of the loan. All questions that you feel not applicable as these were not conditions of having the loan and in your terms and conditions I would leave out. Tell them this type of policy was not appropiate for you and that you were not given the option to buy it elsewhere cheaper and cancelable with no interest.
Send it back and reiterate your claim and get a final response. I would also add that most of this information they should already have had and if they did not then its not use asking for it AFTER giving you the loan.0
