PPI Reclaiming discussion Part II

Many thanks Anne.jade. I telephoned First Plus this morning and spoke to the man who is in charge of our complaint. I asked for copies of all the phone calls/paperwork and he said thats fine no problem will sort that for you. I said I want ALL the phone calls on disc and surprise surprise the one which they definately said we had to take the PPI out is corupt and cannot be accessed! I explained to him exactly what was said and also stressed once again that we weren't asked if we had existing cover. I am going to wait for the CD, listen and then send a very strong letter back to them. What are my chances of getting anything back if the most damning phone call cannot be accessed? Also which letter should i send back once I have listened to the cd - do I just reiterate everything that I stated in my first letter. Thanks again to all you lovely people you are doing a fab job and keeping me sane!!!
Hiya
What I did, when I got the conversations, was I went through them and wrote a long letter picking bits out where I knew they had misled me and pointed out parts where I had said I didn't want the insurance and what their response was. It was after this that I got a letter from them offering me an enhanced rebate.
If they are claiming the incriminating one is corrupt, then it should be up to them to prove they did not missell to you. I think you should say in the letter that if they cannot access the conversation, how can they say it wasn't missold? Also you should have got an "It's time to get down to detail" (or something similar) letter from them which showed what questions they asked you to determine whether you needed the insurance and what your replies were. See if you can dig that out.
If you need any help writing the letter when you get the tapes, give us a shout.

Hi there Mark and its good to see you here.
I will help all I can here and Marshallka is also a very good guider here.
I note your loan was in year 2000, myself or Marshallka maybe one of the others here will be able to check if they were covered then by GISC in and I assume these would be, so if that is the case and you were not successful in reclaiming on your ppi the financial ombudsman service would investigate this complaint for you.
Not sure if you checked out the links I sent you, but anyway, you should still try to pursue on this and get a complaint letter in and explain your reasons of why you believe you were mis sold.
I think you still have a case here as the product was not explained to you in order to make up your own mind if you wanted this or not and you may not have been eligible anyway.
Check out that link hun and try to add as much information as possible on your letter, they have 8 weeks to respond to you, hopefully it will be successful first time round but if not another letter should be sent for them to reconsider this and again is still unsuccessful you should be able to take your complaint to the FOS for them to investigate this for you.
We can guide you step by step here, so first thing first, send the first letter.
Wait for the response, then get back to us in order to know where to take it from there.
For the FOS to take a look you will have to receive a letter from the loan company which states "final decision" and the letter should also mention that you would be eligible to take to the FOS.
If this does go as far as the FOS a complaint form will have to be filled in, and if possible enclose any copies of correspondence to include a copy of the final letter from the company.
However, like I said, just post once you have heard and we will take it from there.
You are free to post anytime and if you require further info hunni, please ask anytime, your most welcome.;)
Good luck!
Marshallka, please could you confirm if this is okay for Mark to still try to pursue this, thanks hun.
Di.

Hi there Mark.;)
If separate loans then yes I would sent letters to all you had hunni and yes definately send by recorded post, you can check this out then on the track and trace service on the royal mail website, where you can keep an eye on the dates too.;)
Have you still the agreements to each of these loans hunni ?
If not I would try to contact them and request these, they should be able to supply you with these free of charge, also of any calculation breakdowns in writing.
Still continue with the complaint letters though.;)The one and only "Dizzy Di"0 -

Yeah that is very true...... , now as these are banks would that make a difference hun ?
And yes still worth trying to reclaiming at a cost of a stamp - definately, I had luck with one of mine that were then not covered and fell lucky, so well worth going for it.:DThe one and only "Dizzy Di"0 -

Perhaps Firstplus have misread the letter here. Did you make it plain that this was for the unfair rebate of the PPI?
As regards Lombard, yes make the complaint to them.0 -
