so what is the best thing to say when our orders are declined?
not sure whether to be upset enuff to ask for vouchers or just let it be.... at least weve had a giggle.... probably done by someone who left the company on friday LOL

I still can't believe that anyone thinks that they will get this offer. You are of course welcome to try to win in court, but you would be wasting your time.
When you ordered this TV, you had to agree to the terms and conditions set out by the company. These are very clear, and make it very plain that you are not entitled to this TV.
2.3 Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it
Untill they send you out the TV, they have not accepted your order.
4.2 The price you pay is the price displayed on this website at the time we receive your order apart from the following exception
While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
You have all agreed to these terms. Now the shop is trying to apply them you are trying to say they are out of order. These terms make very clear that you are not entitled to this.
No judge is going to decide in your favour. This has been tested in court already, and a precedent has been set over mispriced items.
The precedent on this issue was set by Hartog v Colin and Shields in which there was a pricing error where the seller thought he was pricing per pound, but the cost was actually calculated per item. The Court held that purchaser could not reasonably have supposed that the offer expressed the real intention of the persons making it, and must have known it was a mistake. The purchaser therefore did not, by his acceptance of the offer, make a binding contract with the seller. This would therefore give an on-line retailer a defence if the price of a product was so ludicrously low that the intention to create legal relations could not be formed. It is on this point which Argos had a particularly strong argument.
Basically, because the price was obviously an error. When you ordered you did not make a binding contract with the shop.How many surrealists does it take to change a lightbulb?

The law will have been broken by " breach of contract " . The offer to sell was made , the offer to pay was accepted , the payment was taken .

So you are so sure are you? Courts are always ruling in favour of the consumer!!
Im not getting wound up, as I didnt think for one minute I would get a TV...However As I have been told I have a chance, i will pursue it, and anyone who does and gets one, bloody good luck to them....So if you havent got anything constructive to say, then maybe its best u dont say at all, as we are all havinga convo about whether it is worth pursuing!!In this trusted place U can erase

Can you imagine the meetings and scared faces behind the scenes today? Not least the programmer who made the mistake. Considering its all over the internet and in the papers it should have been sorted today. do you reckon they are reading these sites and know what we all saying. Until we get the email it's still fun hoping. If we get ours our current tv will go to the home where MIL lives. They got a stupid small one in the corner of a large room that half the residents cant see.0
