    when we signed up they only had good reviews everywhere. it's a shame that they have gone down hill, and now they are all over MSE and the moneysupermarket forums.

    i would advise people who want to do, to be prepared to lose if they go bankrupt, as they have definitely changed for the worse.
  • Re missing page scam.

    I requested a copy of the bill from O2 and I have sent this, plus a letter stating that I have a witness who will testify that he verified the documents and watched me seal them in the envelope.
    I have said that if they do not process my claim within seven working days of receipt of the letter, plus agree to honour the last claim, I shall commence legal proceedings. I checked with Royal Mail and the letter was delivered on Friday - so the clock is ticking,,,

    Has anyone else heard anything?

    we got a response to our letter sent on friday about the extra pages, they strangely sent the following email, which is the one you get for submitting your form....very strange!
    We can confirm your claim has been received and date stamped on arrival by our mail sorting office. All mail is given it's own unique id so we can track the item within our organisation. Your paperwork will now be sent off to our claims processing centre where it will be assessed. We will update you by email at every stage of the operation so you can be confident with the progress of your claim.

    I have just spoken with OFT again and there is a suggestion of devolving some liabilty to the provider (ie the phone co) due to the new OFT guidelines. They have advised me to write to the provider and PBD stating that their terms are in Breach of the Unfair Terms etc leg and giving them 7 days to pay. They have also advised that if sufficient complaints are made to them they can ask for a ruling on the T&Cs (and possibly the liability of the provider who is less likely to be going bankrupt). Their number is 08454 04 05 06, so get dialling folks........
  • Oh dear, after all that I failed to complete my claim form correctly - I didn't show which claim month I was applying for, I didn't delete the other ones :confused:.

    I got a letter this morning saying that they won't pay because 'CLAIM NUMBER NOT ADVISED' - i feel sick, is there anything I can do about this obvious nit picking?

    £420 down the drain :mad:

    Did you check your copy of the form to make sure that you definately did forget to cross out the other months?

    I don't suppose you are still within the 30 days to submit your claim are you? Maybe you can send them in another copy of the form if you are?

    Failing all that, I would send in a letter to your provider as well as PBD as suggested by fedupwithphonebox in the post above yours, it cant hurt and it does seem a very flimsy term reason for rejecting your cashback claim!

    Thanks for your sympathy, I'm sooooo angry with myself :mad: I took photos of all the paperwork & yes, I've checked and the school boy error is there :(

    It's well over the time limit now, because I was waiting weeks for my phone bill. I think I'll try the letter approach, like you say it can't hurt.

    OK a week after submitting claim 2 after receiving 3 emails saying claim 1 was progressing I have had claim 1 rejected as the number I put on it which was the only one on the invoice was apparently the invoice number not the order number. I am minded to take this to the small claims court, I know I have not followed the T&C to the letter but it only costs 30 quid and I guess my case will be that I met the substantive part of the T&C and that they could just deduct their administration charge. Any suggestions?

    Newbie, but guess I'm in the right place here. Took contract with PBD in March and they sent me link to cashback form with Mobile Media Systems, PO Box 8161, Cotgrave, Nottingham NG123WL. Sent off Stage 1 form in correct time to this address and 6 weeks later received a 'addressee gone away' letter from Royal Mail. After emailing MMS, worried a company owing me £420 worth of cashback had gone bust, they emailed me back immediately stating as the claim had been sent to the wrong address (not used by since 2006 apparently), this claim and all future ones would be invalid. I've got the print out from my email, I couldn't have made the cashback claim form up, have proof of delivery in the correct time period, sent the right bills in and since I've just lost £420 am seriously tempted to complain to all and sundry. But, who and how? Help
  • Don't. Just sue. If the address had ceased to be correct the previous year and you have the copy showing the one they gave you what's the problem? Companies who do change their address can and do have their post redirected for a year. I got my first deal with the sister company in March and my address was correct. Send a polite, clear and specific Letter Before Action giving them 14 days to pay and then commence legal procedings if they don't. I'd be more than happy to sure them under those circumstances to get ALL my cashback in one go. In fact, I've just sent an email along those lines because they are taking so long to "process" my first claim (which I have no doubt WILL be approved but I am more than happy to sue over if they don't - I even prepared various draft Letters Before Action before I sent it, allowing for possible things they MIGHT try on). In my case despite being told three weeks ok that my claim was fine it only reached the "scheduling for processing" stage over two weeks late - so it's quite clear this is a game. If you want to win, you definitely can.
