Even if all I've got is the print out of their original redemption email, not the actual email. What's your experience of MMS- do they pay up if threatened with court action or brazen it out hoping you'll give up. Even better, has anyone taken them to court?0

Rule one; ALWAYS print copies of EVERYTHING - the offer, t&c etc AT THE POINT OF SALE. Obviously KEEP all emails so you can prnt them off again. Print off spare claim forms - and so on. 1) You didn't pluck the address out of thin air. 2) They admit it WAS their address last year. 3) An "original" email is still only a copy. 4) They have acted extremely unreasonably and unfairly. You didn't say but it might help your case if you sent your claim by recorded delivery - which I suspect you didn't. Furhter, if you DID, they MIGHT ask why you didn;t pick up the non-delivery sooner by track and trace (though I could think of one or two answers to that).0

Thanks very much. I did 1 thing right. I did send by recorded delivery although I didn't track and trace it, but it was only returned by RM 6 weeks later stating addressee had gone away.
Have just emailed MMS serving notice of court action (I assume that email's fine?) and copied Dextra in on it.

Afraid not. Letter by Recorded Delivery and worth spending a bit more time drafting it! Can do that now while witing for their response. They will I suspect take your intended course of action more seriosuly if the letter is recorded and well drafted! I also doubt they'd actually let it go o court - but I'd be more than happy if they did since I'd be claiming the full whack plus court costs and statutory interest. Good luck!0

Hi guys. So its my turn to prepare sending this form. Here are the details:
I bought the phone on the 17th of April, but my connection date was on the 25th of April, confirmed over the phone just now. I had to confirm that since there was nothing on my 1st bill mentioning that.
My first bill is dated 17th of May.
My fourth bill is inconveniently dated 20th of Aug. Why inconveniently? Because adding 120 days to the 25th of April, shows that I should send a bill dated 23rd of August or later.
Meaning that I should technically send my next bill which will be dated the 17-20th of September. But that sounds dangerously late: by the time I receive that bill, it will probably be around the 24th (Happy B-day to me; 150 days after connection date), and if they actually wanted my 4th bill, I'd have zero chances. I am thinking of sending my claim this week. I'd rather risk £10 than £420, though I am also worried that by sending off my original bills, I would have to settle with copies if I do need to make another claim next month.
Please advise: is it so common to have a bill so near before the due date?0 -

I'm in the same situation as you, with inconvenient bill dates...
My conenction date was 20 June 2007.
I'm supposed to make my 1st cashback claim after 120 days, which is 18 Oct.
With a 21 day deadline (as stated in my original T&Cs), the claim would need to be submitted by 8 Nov.
On 18 Aug, i received my first bill, and it was dated 9 Aug.
Will that mean all my bills are going to be dated the 9th of the month? Because if that's the case, i'll get a bill dated 9 Oct (which is before the 120 day mark). The next bill will be dated 9 Nov, but i'll get this around the 18 Nov which will be after the 21 day deadline.
But if you check their website now, you'll see they've updated their T&Cs...
"We will only look at claims received within 60 days of the correct bill date as described in the cash back claim section above. Claim files are closed and cannot be reopened after this period"
Can anyone confirm if we can all use the latest T&Cs off their website? Or will they try to stitch us up and say we have to use the T&Cs that were in place when we took out the contract? I know on the claim form it does mention something about checking their website for the latest T&Cs before submitting a claim, but i thought this was more for their benefit, not for ours.
If the 60 day rule does apply, then TooNice and I should be ok as we can wait for the later bill to arrive (that's dated AFTER the 120 day mark).

You have misread the t&c anyway. It is 21 days from the relevant BILL date. There's plenty of feedback over a LONG period on here.0

I've read every page on this thread and the T&C, but I am still not very much at ease. Basically, is undoubtedly certain that I should send a bill that is dated 147 days after connection, 160 days after my connection (since I need time to receive/send), rather than the bill that is dated 117 days after connection, 130 days after my connection? Does this happen with everyone else to have the first bill fall just short of the whole month after the connection [why would they even do that?]?0
