    Fair enough - although I print the forms off immediately just in case. There are lots of threads on here where people have mentioned the t&c have changed on other companies' websites since they prchased; now Mobile Affiliates have done the same, with no reference to the previous versions (or dates).

    Why don;t you simply download the new forms, send them in as soon as the CORRECT bill arrives and make sure they are done properly and to the letter of the t&c there NOW? That way you should be covered. Even if there was a more sustained postal strike and they arrived a day or to late (though shouldn't do) you could still pursue it legally IF they didn't pay, since they KNOW their t&c when you purchased DID allow one calendar month. That much (downloading the newer form version) is probably a system change rather than anything sinister. The same applies to the delivery note (if you could call it that!). I kept mine in the box even though I don;t need it. But it was NOT a requirement when you got your phone (I got one in March too). Now, just make sure you have worked out the correct bill to send in EACH time. And copy some extra claims forms before they go to 14 days like some are!

    I have not got the dispatch sheet anymore........ as I did not require it under the terms and conditions of my contract, so I threw it away. So that puts me off using the new form!!!!
    So really I just need somebody who has saved the origional cash form on their computer and can email me it. Methinks this would solve my problem.

    Is there anybody out there who can help me!!!!!

    I'm still not convinced about that number at the top. I have 2 lots from Phonebox and Coolnew and numbers look like they may be different. Although the fact you can download them now even though updated may suggest not. In any case, it's not that difficult to establish that the t&c you signed up to did NOT involve the despach note OR 21 days for that matter. If they refuse on either basis and you HAVE sent (albeit the new) forms in on the original timescale WITH the RIGHT bill RECORDED delivery (at least), then the legal route is straightforward and I can't see any problems getting your money. I doubt it would need to go that far though.

  • Right Mustbemad, Thx again for your kind help........ and also to you mobile junkie..... but if you are interested here is a real puzzler for you.

    I have sucessfully claimed the first 4 claims from a phoneboxdirect phone which i purchased last APRIL 06, connection date 9th April. When it came to the 5th claim I posted it in as normal and within the specified times.

    Now while in the last month of my 12 month contract i aggreed with "3" that I would change my priceplan from a £35 per month to a £20 a month. This change kicked in on the 9th of April 07, exactly 1 year after connection date. As i had paid the full amount that the contract was worth (£367.50) 3*17.50 and 9*£35 I sent the correct bill, feeling sure that there would be no problem.

    But Phoneboxdirect have sent me a letter stating that I am not allowed change my contract before the end of my contract and have refused to pay my final claim. Now it is obvious that I have in fact paid for a 12month contract and whatever I want to do after that is my business.

    What do people out there think do I have a case?
    How can I go about challanging this if they refuse to pay after a letter from me. I have all the evidience, so that wont be a problem.
    Does anybody else have the same thing happen to them?

    Does anybody think Phoneboxdirect are correct and Im wasting my time?

    Hi; it seems to me that their ONLY argument would be the condition "All cash back claims become null and void if your tariff is changed within the contract period". Since you merely gave NOTICE to change at the END of the full 12 month contract I can't see hopw a court or anyone else would interpret THAT as breaking their terms and conditions.

    IF you haven't already:-

    1) Check the bills VERY carefully to ensure the change didn't happen BEFORE the end date (different networks work in different ways so make certain they haven't done it before or made a mistake).

    2) Write a reasonable letter to Phonebox explaining that you have definitely NOT changed the tariff within the 12 month contracts - restating the connection date and the change of tariff date together with the evidence from the bills or written confirmation from the network (might be worth getting the latter to confirm the actual change of tariff date in writing, in case you need to take this further or want to include a copy of said letter in your one to Phonebox).

    3) If they cannot justify their decision on reasonable grounds and still refuse payment, visit http://www.hmcourts-service.gov.uk/infoabout/claims/index.htm and read through. Apply on-line and make sure you add court costs (and other small reasonable and evidenced expenses in pursuing the claim such as recorded delivery cost for the pre-metnioned letter, and phone calls) PLUS interest.

    4) If after receiving ther summons they pay but exclude the costs, carry on until they do pay the costs as well (they'll have to at that point, basically, one way or another). IF there's a hearing it will be informal and local to you and you won;t need a solicitor. I very much doubt they'd turn up, but work on the assumption they would. However, I'd be most surprised should it go anywhere near as far as that!

    Just got my 1st refund cheque yesterday - 80 days after the date of my 4th bill

    Pure co-incidence of course that it's dated monday, the day I finally got fed up and said if I didn't get it this week I'd see them in the small claims court

    Won't hold out any hope for numbers 2,3,4 and 5, but at least it's the equivalent of bringing my line rental down to £28

    Usually the second email says that the claim is being processed and they will have the paperwork out in 28 days. (yeah, right) This email suggests that I am still waiting for an email to tell me my claim is being processed :mad: to think I used to think they were taking the mickey when I was waiting 2 months for my cheque! Its been over a month already and it looks like i have at least another 2 months to wait judging by how long it normally takes them to write the cheque and post it.

    Well i would be interested to hear from anyone :)

    I threw my despatch note away cos, like tinkerpooh I've done loads with phoneboxdirect before and never needed it. Do I have any chance??

    1) they told me the other day they would send me another despatch note if I requested one.
    2) I kept mine, but if I hadn't I would take my chances in the small claims court if they refused my cashback on the basis that they retrospectively asked me to send something which wasn't required when I took out my contract months ago and had no reason to keep.

    I got the impression when I spoke with them generally that they are simply trying it on and don't have an awful lot of confidence in their new demands on existing contracts. I would call them and ask for another copy of your despatch note asap and keep on at them until it arrives. If it hasn't arrived in a few days I would also email them so you have a record in writing of your conversation should they never actually send it. I for one wouldn't just lie down and let them get away with it, but somehow doubt it will come to that if you stand your ground and they believe that you will. Let us know what happens! I'm certain there will be many people in your position and the more feedback on here the better - for many reasons!
