Mymoviestream problems

• I have to admit to not reading the terms and conditions. Also, I didn't cancel with them: I had a payment fail and didn't want to continue with them, so didn't contact them to pay them the outstanding month. Maybe I am slightly to blame, but still they never contacted me for payment which they should've done before contacting setting the debt recovery agency onto me. I'm worried as they are chasing me for rather a large sum of money, and I don't want any trouble from them, or more costs to mount up, or be taken to court over this, so I've contacted CARS and paid them. Also have put in a report on the Watchdog website, but this has me so worried that I'd rather just pay the amount and not have any more trouble. More often than not it is the little guy that loses out against the big companies._______________________________________________________ditto

I e-mailed CARS and said I would not consider paying them until I had received a breakdown explaining exactly what the £95 was for. I had a reply from a team manager saying he would contact mymoviestream and until then there will be no action from CARS. That was over a week ago. I receieved a letter threatening court action, but this was sent the same day as I e-mailed them. I e-mailed again just to check and they will not take any action until mymoviestream can say exactly what I am being charged for. I also e-mailed mymoviestream asking them for details and pointing out they had already used a different debt collection agency to get £25 from me. I have had no response whatsoever from mymoviestream. I'm hoping this will be the end of it!

Mikey, I am in the same position as you; my cards got stolen and I forgot to update my details on their system. That's why I paid the £25 because I thought that was for the 5 months missed payments. I have not intention of paying the £95 to CARS though.

Has anybody had any joy in not paying these people then?

I have the same problem as the first post, and do not see why I should pay this.

I've reported them to watchdog and Trading Standards, and also have an appointment booked at the CAB.

This is really stressing me out

Thanks Mikey, i really hope somebody gets the better of these a@@holes! I've seen another thread with a directors address, which i'm going to write a formal complaint to. A friend has advised reporting them to the financial ombudsman if I get no reply.

Another friend has also suggested contacting the major film magazines, Empire, Total Film, etc just to help draw attention to the issue.

I think a strongly worded letter of complaint to this director mentioning I could do this will be a good start. Busy day at work for me tomorrow then!

I had my appt with CAB today, and together we found a neat little loophole in their T & C's that will hopefully get them off my back.

'You must have internet access and provide a valid means of payment card to redeem a free trial offer'

I never entered any payment details, hence why they've not been able to take money from me, but according to the above I was never valid for even a trial period!

He has suggested I amend my letter to the above guy to state this as well as my formal complaint, and the list of actions I have said I will take and hopefully that will put a stop to things.

He also brought to my attention, and has said if they still persist in chasing me for money, we can use the following, which could still be helpful to people who have entered their payment details

The Unfair Terms in Consumer Contracts Regulations 1999

http://www.oft.gov.uk/advice_and_resources/resource_base/legal/unfair-terms/guidance#named1

Hope this helps people, I am determined these scumbags aren't getting a penny of my money!!!!!!!!!!!

Has anybody had any joy from this company?
I joined up for a free trial, I tried logging into the acoount to cancel and I couldn't then when I was finally able to log in it was the day after my free trial expired and they had already tried to attempt to take a payment. They have tried several times but the bank disallowed it, I think it's because I didn't have enough funds.
I contacted them through their site but no response was given. After several attempts of phoning them and recoreded messages playing then getting cut off, I finally got through by pressing the option to make a payment.
I spoke to a man and explained and he said I can only cancel onine, I told him that I understood that but the option to cancel was not on my account, where it should have been. He was EXTREMELY RUDE and I mean the rudest conversation, I could not believe that he was talking to me in such a way. He called me liar, said trading standards could not do anything. I asked to speak to a supervisor and he said no you can't I asked again and he shouted no, then said I am the supervisor so you are talking to one. I then asked to speak to a manager and he shouted no. Isaid that I beleived what they were doing was unlawful and questioned why they believe it is 'safer' to have cancellation only via the website but they can remove the link whenever they want. He said he was actually studying to be a barrister and there were no laws against anything and I had to pay. He then said he's taken the money from my bank account and the link was now there for me to cancel. The bank said they could not stop any payments.
The cancellation isn't actually a cancellation either, it is a sort of hold for your account giving you 7 days to return the discs. From reading around the internet they will try and say that the haven't recieved the discs anyway and keep on taking payments out. I am very annoyed and I can not beleive that companies such as Ipoints, mastercard and egg recommend them / FEATURE them. Could feature them just mean advertise them?
What can I do to ensure no more payments are taken from my account?
Anyone had any joy with the letters etc?
By this time next year we'll be millionaires......
