Right, initial interview with Or went ok-ish. Looks like hubby is going to have a face to face interview to go through everything properly.
Bit annoyed cos he has claimed the float money out of the machines, despite the fact we said we wanted to put it down as drawings so we had money to live on the rest of thye month. Only going to be about £200 at most so not much for him but means a lot to us. Thats if we can get it off Punch who are being complete *****. The area manager collected the keys yesterday evening, complete with another couple in tow who wanted to look at the pub. He then proceeded to call my Mum a liar and insinuate that we had staged the break in. Oh yeah, like we need the hassle of that with everything else going on. And also said we had left the place in a mess, when i HAD GONE BACK tHURSDAY TO CLEAN THROUGH!!!! The only mess left was all the black powder by SOCO when they dusted for prints and the mess from the break in.
Just shows what Punch are like, how disrepectful to take a couple to show them around when my hubby was handing the keys over, it was hard enough and emotional enough for him as it was.
Anyway, hardest bit is over now, I just have about 6 boxes of paperwork sat here needing to be sorted through and accounts to be finalised and I keep looking at them and dreading it.
It's just starting to sink in now with hubby. He's been very emotional and I keep reminding him that he is now officially DEBT FREE!!!!!!
He had a bit of a cry at the court and the clerk said how nice it was to see someone who was genuinely upset by it all, she said she saw too many who saw it as just a joke. The girl before hubby had been BR 3 times in 5 years. I just don't see how that's possible.
Anyway, have to wait to hear from OR about interview proper now. Will I be allowed to go to that or will it just be hubby? he says he wants me there for support cos he's not good in situations like that. Advice welcomed, and many thanks for all the supportive comments, this forum has been an invaluable resource to us throughout all of this.0 -
It is just your H going bankrupt not you? Was the business a partnership? If he was a sole trader you should be able to sit in on the interview with him. A friend or family memeber is allowed to sit in on the interview for support, but they cannot answer the questions for them.0

yes its just hubby, but he gets extremely tongue tied which is why he wanted me there to go through all the figures0

h, i sat in m OH BR interview, just for support but he did allow me to prompt my husband if he was unable to answer, and i did remind him a couple of times!!!
He is totally useless in these situations and just doesnt speak

Face to face OR interviews can be very daunting, fp. Mine lasted three hours and although the examiner was extremely courteous, offering coffeee and allowing me a 'smoke' break, it would have been much easier if I had had someone with me - just for a bit of 'support'.
If you can go, do - he will appreciate it.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Right, a few problems. Hubby has spoken to OR about the machine income, ie our part of the float that we put into the quiz machine and fruit machine. This should have been emptied on the Wednesday morning hubby went pop but the company never turned up (not unusual for them). This then would have gone into the business on the cash sheets and out again as MY wages which I take little and not very often as we havent been able to afford it.
Punch have already installed a new tenant and we are assuming theyb have have the floats emptied and claimed them as theirs. OR says he will claim this money off Punch.
This would have gone as MY wages, how do we stand?
Also, Punch have over £3000 as a deposit from us which the OR says Punch can use to offset what we owe them. I thought thye OR claimed all assets and thyen fairly spread them. Surely Punch are using this to treat themselves preferentially?
Also, we own the crockery, glassware, cooking equipment and Punch have access to these, as does, presumably the new tenant (we dont yet know if Punch have tried to sell them to thye new tenant). OR says he will be in touch but that Punch are also likely to claim these. How is this possible when the OR is sposed to allocate our assets?
Really really could do with the machine money to live on for the month, surely he cannot seize MY assets?0 -

The OR is unlikely to sieze money if it will leave you without the basic money for living on, which will be decided on the basis of your income/expenditure sheet.
YOUR earnings will be taken into account, although you are quite correct in that the OR can not, nor usually will, sieze YOUR assetts.

I take money VERY irregularly from the business as wages, I think the last olot was December, purely because we have been having to throw money INTO the business to keep it going. That money we had earmarked as my wages for me to be able to feed the kids for thye month until hubby gets paid again.
But it seems Punch already have their hands on it.
I am waiting for the OR to call me back after his lunch break, surely Punch cannot just go in and empty everything as they have? And how do I emphasise that this would go down as my wages, the first in a while, and that we need it to live on? Hubby has already spoken to OR about it and he has basically said tough, which is why I am now waiting for a call back to try and sort out. Never did we dream that Punch would go in and empty everything, we assumed, as we were told be the Or on Thursday, that it would just sit there until OR got around to sorting it.
I have got to be able to feed my kids.
Sitting here getting quite upset now. Help apprecaited.0 -
right rant time. Apart from the fact Ive just put a reply on and its disappeared!!!!!
OR office has rang me back and agreed that Punch have acted out of order but hae said they can do nothing about it apart from write to them.
Basically Punch have had the machines emptied (including hubbys money).
Or office are checking whther thyey can release funds to me as wages but are doubtful. I suggested I camp on their doorstep so they can feed my kids.
I have got on record that it is MY money and not hubbys but all they can suggest is that I apply to govt redundancy scheme for payment.
Great stuff. I said, had the machines been emptied as they shouldve been WEds it would have gone down as cash in hand and they wouldnt be chasing it. He agreed.
He agreed Punch have acted like vultures and shouldve waited but all he can do is write to them.
We have tried to do the right thing in handing over the keys quickly when we couldve sat on them until court possession order (which Punch have admitted we couldve done) but it seems it has backfired spectacularly. Will NEVER EVER try to do the right thing again, will put ourselves first.
So, still sat here with no money to feed kids, OR will not release so we can claim the £80-100 (HUGE money i know) even though he agrees they could. Car was broken into Mon night outside hubbys sisters house 1st night he stayed there and will cost £60 to pput right. Not loads of money but we don't have it and it means he's stuck in Nottm and I am stuck here. Until the end of the month by the looks of it.
On top of it all, cos Ive changed the address on my Think Banking account, they are being funny and said they need new ID (Ive already sent everything saked and more, wish Id just left it at pub address and not said anything then I'd be ok) explained I'm in a caravan, waiting 6 hrs later for manager to call back. In the meantime, they have bounced back my paypal money which will take another 3 days to go back into paypal acc leaving me with nothing at all.
I've already proven who I am and sent all thye relevant ID and more so why get funny over an address change when Ive been honest from the start and told them Ive opened this acc to get hubby wages into cos he's going BR?
Going to go and cry now whilst kids are out playing as all my previous positivity has gone after a long and shttyi day. just want to have a good sob now.

No apolgies needed, or required, fp. Bankruptcy is not easy for anyone, and is certainly not the 'instant fix' that some believe it is.
