    The only suggestion i have is to kick up a fuss (more commonly known as appealing:rolleyes: )
    You can appeal against any decision the OR makes, but i'm not sure of the process.
    Personaly i think you'd stand a good chance on appeal. Get together as much info as you can and go for it.

    It might be that you had a newbie OR, or one having a bad day so an appeal could come out well for you.

    Good luck...i really feel for you, you've had such a rough time.

    Edit: i believe you have 28 days to appeal.

    Yes, Ive already said we'll appeal if thats what theyre doing. Like I said, its half mine anyway so hubby has a share worth £225 NOT £450, plus if theyre nit picking like that WHY are they not claiming our deposit back and WHY were we told that all our kitchjen stuff worth £700 is not worth sending to auction and basically Punch can have it?

    I am SOOOOOOO angry that they are trying to claim the caravan as an asset and also letting Punch keep nearly £4000 of cash and assets, instead of clawing it back to distribute.

    I'm sorry to hear that FP. I can only think, like BLTN has said, that it is a newbie OR. Did you husband explain that you are living in the caravan. Do you by any chance have a receipt for the caravan?

    That can`t be right....surely if you can`t pay then the OR isn`t going to claim the van & make you homeless!! You have children & you need somewhere to live!! besides which if the value is low then surely the OR would not have interest in it!! I bet they would`nt be interested if it was a PC or Tv or something of the same value.

    As BLTN says appeal !!!

    Your husband is more than likely dealing with the OR, clerk who is looking at things by the book. Make sure you send your apeal to there line maneger.

    Can you prove the caravan is half yours, as the OR deals in proof so if the reciept is in your husbands name they will treat it as his assett, but the reverse apllys if its in yours.

    However if you can prove you helped fund it then you may be able to claim your share regardless

    Not sure how easy that may be though.:confused:

    Appeal on the caravan, and good luck. Phone your OR's office, and ask for name of the Assistant Official Receiver allocated to your case, and then address appeal to them.

    Punch Taverns - they often have a clause in the agreements, and get to keep any bond/deposit in lieu of rent.

    Not sure, it's a while since I saw any Punch leases and I wouldn't like to rely on my memory for specifics. Would depend if they had a charge over the assets of the pub.

    Have just spoken to hubby at a bit of length for the first time today to try and establish what exactly has happened today in the inetrview.

    Apparently hubby was asked if I had put anything towards the caravan and he said he paid for it out of his wages. GRR

    However, I am positive that the receipt, when I get round to digging it out, is in my name.

    Not sure how we stand, but surely they cannot take it off us? Especially as they are not chasing for all the kitchen equipment which are in Punch/new tenant possession and worth more. If I find out Punch charged the new tenant for these I will be kicking up a stink if the Or doesnt then chase Punch for the money they charged the tenant- especially as Punch will have saved the OR office the job of sending them to auction.

    What happens of the OR edcide they are hving the caravan and we cannot pay? They have already admitted that at present we have a shortfall on IandE, which he has gone through today.

    He is sending a new Iand E questionnaire out in a month when we hopefully will have tax credits through (even though I believe they cannot count these or child benefit as income? advice please)

    On the plus side he indicated that hubby may well be eligible for early discharge, something we hadn't even thoought about at this early stage, and which we are nt keeping our fingers crossed for after our dreadful bad luck so far.

    Any technical answers regarding the caravan welcome please, we need all the help we can get at the moment.

    Thanks anyway JCS1 there has to be some reason the OP,s OR seems to be egnoring it, just wondered if that might be why at least the Op can ask if there is a charge now youve mentioned it
