Been very stupid - will I go to jail?

    Quick question: Had a realisation over the weekend that on my loan applications over the years it has always been for 'home improvements' and/or 'consolidation'. Well with the exception of £2,000 which did go towards paying off other debts, the rest (about £15k) just went on living day to day life, and a few holidays. I'm very worried that this will be seen as fraud - I obviously had no intention of spending the money on reconsolidating debts as when the money hit the bank account, ex-husband and I simply started spending again. They will see that by checking the bank statements I should imagine. So does that count as lying on my loan application? Stupid question, of course it does!!

    I doubt whether the OR will even go into that 'depth' of questioning, Terrified. Even if he does, he is most unlikely to view it as 'fraud'.

    So glad you are OK...we were worried about you!!!

    Anyway thought I`d just say that I suffer with the `shaky voice` thing when I`m nervous...sometimes I just ring off & did this several times b4 actually spoke to CCCS . When I did manage to utter a few words they were great & settled me down so I could `collect my thoughts`...then I could`nt stop talking!! think I had held it in for so long ..it was such a relief.

    If you prefer face to face then ring CAB, take your file down & let them go through it with you. This is not for everyone but sometimes having someone `in the know` go through it may really help.

    Anyway also wanted to say glad your lads OK...kids...who`d have `em!!!!

    Mine left home on mothers day can you believe that!!! (By the way, I do know where he is!!...he`s all loved-up with his GF at the mo)...the question is ...do I rent out his room for few extra quid????? tempting!!

  • Thank you Rog2. I hope you're right. My chest is tight just thinking about it!!

    But everytime I'm about to freak out and start getting that 'sick' feeling that is just so overwhelming, someone says just the thing to stop me going off the deep end.

    Can one of you please come and live with me til this is all over? :cry:

    Thanks so much for the constant stream of responses. You honestly don't know how much this keeping me all going today. It's a sunny day where I am, but even sunnier with this dark cloud being lifted from above my head!

    I took out a "consolidation" loan in 2005, then spent it on holidays ect:o . I told the OR the truth and nothing was said. Stop looking for something to worry about, i know thats easier said than done. We women are born worriers so i know it's hard.

    Blimey, what a weekend! You must be absolutley exhausted now. Well done on getting the file together and well done on even opening the letters, even tho you havent actually look at the debt......I doubt I would even be able to open the letters with the weekend you have just had.

    I wouldnt worry too much about what you put on your loan application forms.....you'll be fine.

    The OR, and the Courts, see all sorts of 'bankruptcy' cases - they, more than anyone, can spot the difference between the 'professional' bankrupt, who is simply using or abusing the system for his/her own advantage, and the genuine 'debtor' for whom bankruptcy is the only solution to an otherwise insolvable situation.
    You will be fine.

    Just to say...& I bet I`m not alone here..we took secured loan out to consolidate & then were offered loads of 0% credit on cr cards which we ended up using again on everyday spend (not flash holidays or cars ) but house stuff & eventually were back at square one!! I am not proud of any of this but feels like a vicious circle...I now need cc to pay loan!!

    Thats why we are in such a mess...but now dealing with it!! BIG TIME I worry that OR may see this as reckless & we were really just trying to make ends meet & cc were the easy (& at the time cheapest) way.

    Rog2. You have hit the nail on the head. They say the initial interview is like a screening thing. So if any alarm bells ring they will ring then. The IS deal with god knows how many bc every year and their main job is to sort the good from the bad. Do you not think they are more bothered about those who took out a loan for say £20,000 4 wks before bc than those of us that have tried all avenues except bc to sort urselves out? That includes transfers,consolidation and what ever else we do to try to stay above water.

    Bit like a doctor i suppose he can tell the person with a real illness as opposed to those who just want a few days off work. He has seen that many he knows which are telling the truth and those that arn't. There is always the exception to the rule as in everything.
