Again the law relates to the average person and what they could reasonably be expected to know, the average person would know the car needs to be maintained and topped up with oil, indeed the car documents would advise this as a requirement
In this instance we are talking about an inherrent fault/problem. The average person who wandered into a computer/electronics shop and bought a laptop would arguably not know how many dead pixels that is deemed acceptable... on here we have heard that toshiba speicify ?3 (i think) and samsung dont accept any dead pixels. The average/reasonable person could not be expected to know of this and to be honest I did not know this until reading this thread0 -

Same thing happened to me around December.
Bought a laptop from Comet which had a dead pixel, they replaced it. The replacement had two dead pixels so I went back for a refund. First they tried to fob me and my father off with the statement that I needed to deal with the manufacturer. Then they stated that it was not faulty due to the ISO standards and offered money off the laptop which we refused. We then left the laptop with them at which point they decided to be downright rude and cocky by making comments on how we would never get the money back especially seeing as they would say they never received the laptop. At this point I took out my mobile phone, snapped a picture of the guy packing up my laptop and left.
As my father paid by Barclaycard we filled in a dispute form for it, contacted the Office of Fair Trading and sent letters to both the Comet head of department in our area and the overall head of Comet. Received a phone call from Comet (not the store I dealt with) who said he would contact the store manager for us. Again offered discount or replacement but we wanted the cash. They eventually told us we could go to the store and have a refund. As a consumer you are not expected to know the ISO standards unless the store have informed you about them but even then the store would also have to inform you that they abide by such standards, not just the manufacturers, in which case you can't get a refund.
Otherwise they're blatantly ignoring your rights.
Certainly will not be dealing with Comet again when it comes to these goods.0 -

Excuse me but I have read the whole thread and I was being ironic. I was referring to the fact that Comet were refusing to refund the OP because he had powered it up and was therefore "used" (please note the use of the speech marks):-I asked for a refund and they refused as it was opened, so I asked if they could give me Gift card for the amount but one of the arrogant guys told me it was used as I turned it on, so no gift card voucher credit?
I've read the whole post and was trying to be lighthearted since the OP has had a successful result with the new laptop. If the OP had asked for it to be opened and powered up before buying it, Comet would have no comeback. They would also, using their own logic and argument, be selling the OP a "used" machine.
In future though, I'll try not to be too lighthearted for fear of people like you putting a downer on things.0 -
Don't be pressing your monitor screen, you could permanently damage the screen.
I had this exact same problem with PC World.
Whatever you do, do not accept a repair, as soon as you do they own you.
Stop using the laptop right now, put it back in in its box, if you still have it, take it the store you bought it from and demand to speak to the manager.
Explain you are not happy with the machine and demand a replacement like for like.
If he refuses, explain to him that you are aware of your customer rights quoting sale & supply of goods act, and if he does not comply you will take further action.
Don't let him bully you, if the laptop is only a few days old then you are well within your rights "if there is a problem"
to demand a full refund if you so require, and a like for like replacement at the very least. Try to get the same model if you can, I take it you have done a lot of homework choosing this laptop, if you change it for something else you may not get what you expected.
If the same model is unavailable, choose to have vouchers, so you can do some homework in deciding which model.
Whatever you do don't lose your rag, take someone with you as a witness, and make sure you understand your rights before you go. Be clear and precise, sound like you are confident about what you are saying, and don't be bullied, after all you are right, and they are in the wrong.
I made the mistake of opting for a repair, now after a partial refund, two, yes two new MOBO's a new DVDRW and some other stuff I finally have a laptop that works, but for how long is anyones guess.
Oh and good luck, your gonna need it......To travel at the speed of light, one must first become light.....0
