poochie1103 wrote: »sorry to jump on this thread but i would like to get others opinions of how i should proceed now.
i have fibromyalgia, arhtritis, diverticulosis, carpal tunnel syndrome as well as aneamia, vit D deficiency as well as few others things going on and have had so for several years.
I kept workin although my absences were gettin bad, and my own gp told me it was time to think of giving up work and applying for disability benefits.
Anyways, I went thru the procedures like filling in forms, gettin doctor letters etc and everything was happening as it should but i was refused because i work 16hr week. I do this over 4 days doin 4hrs each day as its all i can manage and i dont want to give up my job until i absolutely have to as i know depression would then set in.
so I was refused because i work and can drive myself to work.....so I appealed saying they were discriminatin against me because i can manage to work 16hrs and drive altho i dont always drive myself, some of my colleagues come and collect me as we on same shifts etc....
anyways, i got refused the appeal then i got refused permission to appeal which i feel is very wrong because my doctor things they have not paid attention to the medical facts and figures in my claim....Even he said they have put too much emphasis on my ability to hold down part time work.
I did have a rep but he never filled in forms for me, nor did he apply to my work or anyone for proof of my illness and my absences from work. I asked this rep for meetin before assessment and he said i dont need..... then he told me on day of assessment i will probably fail because i work.
In the meetin, i was on my meds and they asked me questions which i couldnt answer because i was havin a fog day and couldnt remember names of pills etc......
Wen we got cd of the assessment, its quite clear the rep made a few errors.....he had sent forms for a certain rate but in room he mentioned another rate and someone elses name.....he had names mixed up of who he was in with and altho i mentioned this in appeal letter, nothing has been done about it.
I am at loss what to do now because i feel this whole process has been wrong for me and they never got all information they needed and my doctor had written 2 letters to them and he even said i was capaple of havin memory loss days, and days where i am not understanding what people say and that i could cause harm to myself unintentionally etc.
I have applied for pip and awaiting on that because i had to have aids from occupational health to help me get in and out of bath or seats or car......and especially bed....I cannot use walkin aids due to nerve damage and i cannot walk distances because of arthritis which is why i refuse to give up my car just now...... so all in all, i am at loss as to why i have been refused and keep getting refused and I wonder what i can do now.
I do feel i was mis represented, as i only sought help after i was initially denied dla because being a worker all my life and my partner works, we did not think we needed or would get free help to apply but even after we sought help, the free help rep did not fill in any forms or help in any way.....i was told to fill them in and send away and just saw he was my representative....... he only filled in parts of the form he needed his stamp on.....
can anyone advise.......at the moment i have been refused twice permission to appeal to UTT
thanks for reading
You can get DLA/PIP when working, and many do, so I don't think that just the fact you do work would have caused the rejections.
It could be because your job content suggests you are fit enough not to need DLA or PIP?
Did you look, on your rejection letter, at exactly why you got turned down? It wouldn't just state it was because you have a job, so look at why you were turned down before you submit an application for PIP.
You also need to seek some help from the CAB or welfare rights (google for local ones) in order to maximise your chances.

HI . I think you may have taken the wrong path . PIP is the one you should have taken . Completely separate benifit go to PIP HELP on GOOGLE has site that have a self test , it follows the point system that should be used to decide your entitlement .0

DLA could of been refused on the grounds that your work contridicts the info put down in your form...Can't walk distances, can't use walking aids because of nerve damage. Need aids to help with getting in and out of bed, car and seats. Memory loss, danger of causing harm to yourself, but your still managing to work, this is what they look at and they may think it the info is contridictory.0

OP: Yes, the work you do needs to compatible with the difficulties you are stating you have on the PIP form (DLA no longer exits for new claimants or anyone needing a review of DLA as PIP replaces it).
What is your job?
