    Looking for a bit of help please. Having asked for CCA from cc companies have received back from Clydesdale and Monument. Monument have sent back a copy of a rapid reply card which has signature on and also enclosed a copy of terms and conditions, these are the up to date T&C as they have late payment fees etc at £12. This account was opened in 2003.

    Clydesdale have sent a signed application form and states in the letter that they have sent the T&C from 1999 when account was opened. Reading the T&C they also have late payment fees etc of £12. Are these agreements enforceable? Also both T&C have address that I stay at now not the address I stayed at when accounts were opened. Thanks for any help/advice you can give

    From what you say, sns, neither of these 'agreements' would constitute a true and compliant copy of the original executed cca, and would, therefore, be unenforceable.
    Have the 12 working days, since they received your request, elapsed? If so, send them the 12+2 day letter to inform them that they are, now, 'in default' and can not enforce the agreements.

    scarednshakin just two let u no i got an application form back witch was a moument card but they sold it on two lowells it didnt take long for them two accept that they could take it any further and i got a letter saying that they would remove all data from there system and that i have never heard from them or any 1 else since so good luck

    hi can anyone point me in the right direction for the link for cca 12+2.req cca from mbna on the 20th july and had no response even tho they have cashed the chq.thx

    Don't be scared Trish - it actually puts you in a strong position as they have been unable to provide an enforceable CCA. Save what payments you were making into a separate account in order to make a low F&F when you can afford to.:)
