Can I get a quick bit of advice?
I took out a Skycard (applied online) Oct 2006. Received copy today of T&C's along with what looks like my online application.
Just want to confirm that I am right in thinking that this is still enforceable due to the date of application even though obiviously no signature.
TIA for any advice:beer:0 -
We have been chasing a cca from Hillsden for a credit card debt for several months. They sent a copy of the application form, signed and dated over 5 years ago but this was all. I responded saying that clearly it was an app form and didn't include any of the prescribed terms (which it didn't).
This is their reply:
'The account does not relate to a fixed term agreement therefore the prescribed terms are not required to be on the face of the agreement. Please refer to the reverse of the agreement where you will find the relevant terms of the agreement. (only one side of the app form was sent)
The agreement previously provided (app form) does comply fully with the Consumer Credit Act 1974 and we are happy to rely on the documentation we have in any future proceedings.
This is our final response on this matter, if you are dissatisfied with this outcome, you may refer this to the Financial Ombudsman Service.'
Are they right or should I follow their advice and take up with the Ombudsman?0 -

They are WRONG, Rianna - Talk, not only to the Financial Ombudsman, but, also to OFT.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi
Not sure what to do about one of my recorded deliveryl etters, have tracked it and it says delivery was attempted 8.8.09 and while you were out card left (was to the RBS). I then went online to arrange a redelivery for 17 august, have checked since and it still says tried to deliver 8th August.
I emailed royal mail and they just sent a standard reply about filling a form in for compensation - I only want to know if the letter was actually delivered -
what should I do, should I resend the letter or should I ring the bank to see if they received it (the letter that I sent to egg stated still at post office when tracked but it had actually been delivered) .
any advice welcome, thanks0 -

Sometimes creditors (in particular dcas) will refuse to sign for letters, but, normally, the Banks will accept them. It could well be that your letter has been delivered, but to be absolutely sure, send a copy of the letter, same date as original, by first class mail. Send it from your Post Office and ask for a 'Certificate of Posting' (free). You can, reasonably, assume that the letter will have been received 2 days after posting it.
They can 'ignore' one letter, but it's difficult to ignore two - you will have 'proof of posting' for both, should it ever be needed as 'evidence'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. Morning all:hello:,
Just a quick update - today HBOS VISA are in dispute having sent to current T&Cs and nothing else.:j
Also, received a letter from Lowdens (on behalf of Shop Direct), acknowledging my letter and confirming that collection activity is suspended on the account. Shop Direct very quickly produced an enforceable copy of my Littlewoods agreement, however with this one for Choice they don't seem to be producing ANYTHING.
Thanks for all your help to dateLBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

The Consumer Credit Act was amended to cover 'on-line' contracts, BJ, but I think it may have been after October 2006.:think:
I'm not sure, so will check on that and, unless someone else can confirm the position before, will come back to you.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Thanks Rog (again). I have searched online but I can't seem to find anything.0
