Just another quick query:o! MBNA sent me a copy of T&C's as well along with a agreement. A box is ticked where my signature should be? Again this is Dec 2006 so I am unsure if this is enforceable or not

If you need Rog I can upload them (well try:p) and let you have a look at them.
The Sky covering letter states your 'signed agreement' is attached.

I would doubt that that would be enforceable.
If you upload the 'agreements' be sure to remove any personal details.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Ok post this moring re CCA's
Barclaycard sent us a letter about a week ago with T&C etc and that agreement would follow. Today they have sent me T&C's again (as requested) and if I need any extra info to contact them - duh! I can only assume they don't have agreement as this card was taken out years ago, circa 2001 or thereabouts.
Capital have enclosed an agreement but have stated on the covering letter
Your personal details, the signature box, signature and date of signature have been omitted from the copy provided as permitted under Regulation 3 of the Consumer Credit (Cancellation Notices and Copy Documents) Regulations 1983 - what the heck does this mean.

Okay, BJ - your next contact with Barclaycard should be the 12+2 day letter, to inform them that they are now 'in default' of their obligations under the Act. Don't be misled by any other letters asking you to 'contact them' they had a legal obligation to provide you with a true and compliant cca - they have failed.
Capital 1 are correct in that they do not need to provide you with a 'signed' copy of the 'agreement'. However the 'agreement' must be both compliant with the terms of the Act and be a true copy of the original executed agreement. Are you happy that what they have sent you complies with the required terms?I am NOT, nor do I profess to be, a Qualified Debt Adviser. I am just starting on a chocolate cake and a chicken pie (hope I don't get the ingredients mixed up:rotfl:).
So when I do this with the kids I will read through it more carefully and also upload so you can cast your eye over them.

For the sake of a £1 Postal Order, I would enclose another - this would prevent them from 'claiming' that you never paid the Statutory Fee.
You should be able to check if the first PO has been cashed - if so, you will, reasonably, be able to assume that they did receive your first request.

HI I JUST RECIEVED A LETTER FROM LLOYDS stating its a copy of my original agreement thats been updated with my present address...( even though its reference is for a credit card not the loan i requested it for ...) its just a print out of the terms and conditions, with my name address on ( not same address as when loan was applied for. ) credit limit..WILL BE SET AFTER WE HAVE OPENED YOUR ACCOUNT. APR RATE....is shown on your original agreement !!! TOTAL CHARGE FOR CREDIT,, is shown in original agreement.. ect. no amount of loan, ect its just the terms of agreement as far as i can see...they state that they do not have to provide me with a copy of the original signed agreement and that this fulfils there obligation. can someone tell me what i am looking out for. and how should i proceed from here... there are no signitures from me or bank.... ect so a far as im aware they still need to send me the CCA ?Hi, we’ve had to remove your signature.
