Not sure if this is the right thread. Here is something I found on CAG regarding 1st Credit. Seems they are being watched......

Very interesting. I am dealing with 1st Cretins at the moment that helps alot. Think I will write back and say this is my final communication until a valid CCA is produced and should they continue to pursue the debt then I will REPORT TO THE OFT - and underline it! Should draw their attention I think.0 -
This morning I recieved a letter from Nat West telling me that the agreement has been misfiled and they are unable to locate it.
They then go on to say that if we decide not to meet our obligations, they will be unable to persue recovery through the courts, but the agreement isn't void, it remains valid and a continuing default will be reported to the credit reference agencies.
I thought that they had to remove references? - not that it really bothers me one way or another - I prefer having defaults - it prevents hubby getting more credit!0 -

Okay, not really posted on this thread before.
1) Requested a CCA from a DCA few weeks back. Got the usual 'we are requesting the client to retrieve the documents from their archives and will expect full payment when we receive them'. Except, shouldn't they already have that document eg Deed of Assignment if they purchased the debt?
2) Received reply from creditor NOT DCA just in the last few days stating they don't have a CCA but 'here's one we prepared earlier' bears no resemblance to the document I saw, but states it covers all relevent arears. But no personal details, no credit, everything is blank except for the usual T/Cs. Just before I received their letter the DCA tried to offer a reduced settlement as !!!!!!. No way could I pay what they were asking anyway and was given one day to do so despite the date on their letter.
3) Just received a letter today - sent just before I got the creditor's reply so the DCA MUST have surely been aware of this? - from the DCA again saying they are still awaiting the creditor to pull the documents from their archives, want full payment when they do. As you can see it's all very confusing as creditor says they can't find one yet DCA now says they ARE retrieving one from their archives. Either way they don't get a penny from me until they do. I have an idea what's gone on here because with assistance from another consumer forum last year, I was told the document I did have wasn't enforceable. So, could it be a case the creditor knows this so has provided a more up to date blank one?
Any ideas on where I should proceed from here? Should I just leave things until the DCA produces something - they are now well outside 12 days for example and also in default of my request - or do I need to write back?Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Offered freely, is gleaned from a lifetime of experiences, knowledge gaining. Passed on to benefit others. I may be direct, ask you questions but those are to help you. Up to you if you choose to take it. I won't judge you either way.
