  • Hi

I'd appreciate your opinions on the CCA I've received from First Trust:

    Do you think it's enforceable?[/FONT]
  • And for anyone who'd like to get confirmation of any recorded/special delivery items to PO box numbers with a DCA/creditor you can do so here:

    pod.team@royalmail.com

And they will usually send you a copy of the Bulk Delivery Card. Just something useful for anyone whom, like me a few months back, never knew such things existed. Cos I got my signed proof within seconds by email off them. Whereas I couldn't get confirmation by phone or track/trace.
Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Offered freely, is gleaned from a lifetime of experiences, knowledge gaining. Passed on to benefit others. I may be direct, ask you questions but those are to help you. Up to you if you choose to take it. I won't judge you either way.

It's an "Application Form" application forms don't contain the prescribed terms = unenforceable ;)
Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional

Darn, I was gonna say that. But was waiting for another opinion. :D

Great news! :j Could you tell me which prescribed terms are missing so I can list them in my response to First Trust?

    Thanks

Icanandwillsavemoney - Mercers are Barclaycard in disguise, they are an in-house collection team.
I had a similar problem and just kept sending them a copy of the 12+2 default letter. I never received a meaningful reply to any letter I sent Barclaycard/Mercers. I made an official complaint and ended up complaining to the Ombudsman who sided with Barclaycard who promptly, and against the Act, sold my account on. This then led to CCA requests to RMA & Moorcroft - none of whom could supply a CCA. I haven't heard from Thames, who have the account now, for over 6 months as they cannot provide what probably doesn't exist.

    Thanks.

mercers called me again yesterday but i refused to answer security questions so she said she would keep ringing until i started to respond. I said they had received letters stating telephone harrassment and she said they would continue to call until I paid up!. Still no CCA and I am still waiting on SAR info.

I think from now on I will follow 10past6's advice and just say 'put it in writing' then hang up. I am not willing to be spoken to like this anymore. I am not a piece of dirt that needs to be spoken to like I am the lowest form of life.

You need to upload it via this site first.

Can you tell me how to do this please? I've looked in FAQ's which says go into 'manage attachments', but when I try this the message says "you may not post attachments."

Not sure if this is the right thread. Here is something I found on CAG regarding 1st Credit. Seems they are being watched......

If you have sent the telephone letter then report them to the relevant authorities. Off the top of my head I cant remember which but sure someone else will tell you.
