  • Mmm. Well, good question. However, I posted quite deliberately elsewhere to test that theory. Within five minutes of my posting, phone call. Tested it several times in a row. As to 'how?' Well, how did they find out your new phone number? Councils, for example, have had that ability for quite some time now to 'eavesdrop' on people's personal lives. Plenty of cases in the press where it has been misused/abused on very trivial grounds. Neighbour falling out with another, works for the council ... and so on.

I am not saying that is what is happening but when things happen 'coindentally' and converge then I do start to think a little about them more. I proved what was happening in my case above. I'd come out of hospital, the creditor had been silent for weeks, within moments of me posting where I'd been, and about that very thing guess what? Phone calls started up but had been silent for weeks. Random? Possibly, but when I logged the calls, the times, they all coincided with my time on that forum. When I wasn't they were not calling me.

The other thing is DCA employees DO read these forums. And, if they have enough info about your case, what amounts and so on, they can easily spot you. That is why I do no longer give out specifics, unless I have to, including DCA names, amounts.

But, you log them as suggested further up this thread and take note of when you are online and see if there's a definite pattern/match. I could go into how someone would do so but that's too technical. But it's nothing that is not already being done, can be obtained online freely to do so.

Again, not saying that is what is going on just 'suggesting it' because when you posted that it reminded me of certain things.

  • Hi All,

Could some of you look at my posting 2312 and give me some advise or comment, I'm looking to send a reply to this letter sent by this dca as I have been pondering it all day at work and I'm getting madder as the day goes on.
I have sent the 12+2 day letter and my posting 2312 was the dca's reply.

This morning I recieved a letter from Nat West telling me that the agreement has been misfiled and they are unable to locate it.
They then go on to say that if we decide not to meet our obligations, they will be unable to persue recovery through the courts, but the agreement isn't void, it remains valid and a continuing default will be reported to the credit reference agencies.

I thought that they had to remove references? - not that it really bothers me one way or another - I prefer having defaults - it prevents hubby getting more credit!

Thats an excellent result Natters, i cant help you with the defaults bit though.
But my understanding is that if they dont have a CCA then they had no right to default your account.

This is just my VERY limited understanding of it.

Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional

These payments act as an admission of your liability towards this account
    Based on what?

Hi would like some help please. My partner has received a letter from lowells for a bank account however it is not on his credit file. Could this be because it is past 6 years? Also would could anyone suggest if it is advisable to send a SAR request anyways?(I understand CCA do not cover bank accounts ?????)

Does he admit he has the debt? Was it from more than 6 years ago?

Are you meaning, because it's a bit ambigious eg could be read two ways, that he doesn't owe this debt as it's not on his credit file or that you mean he's never had an account which Lowells are chasing him for? Clarity is required. Thanks.

Before doing any of that we need to establish certain things.

Sorry for being ambigious. He did have a Barclays account but we dont understand how its not on his credit file we not sure if its longer than six years or not. Is there any other reason for it not being on his credit file other than it being longer than six years??
