  • This is all DCA b*****ks trying to divert your attention. It doesn't matter particularly when anyone tries court action-No CCA should mean action thrown out.

    If anyone tries a Stat Demand or CCJ action and there's no CCA just stick to your guns and see them in court.

    There are other high court rulings where the judge has decided that as there was no CCA it was deemed as a gift from the bank!!

    Must be that more people are going down the CCA route so DCA's are having to try and counter it. The law is still the law.

    What do DCA's always try and do?-frighten you! And that's what they're trying to do now.

    Just received a copy of a CCa from the Halifax today all looks in order

    It states on the Original Agreement that we took out Insurance at a cost of £2491.63 and we have never claimed on this .

    Could we get this Back ?

    If so How ?

    we could possibly then offer this to the halifax as full and Final settlemnt

    Anyone help please

    Just had my first reply to cca letter from DCA statting that they purchased the account 6 years ago and that they do not hold the CCA on file but have requested it from MBNA.
    Do i send the second letter now as it turned up 1 day before 12+ 2 days ?

    A- another DCA have asked me to sign my cca request so that it can be acted on ?
    what sholud I do ?

    what sholud I do ? No You do not have to sign it no way they know who you are as you have given them all of your info they do not need a signature to act on this do not sign anything

    Agree with swt61 - except it 12+2 WORKING days. If nothing by then then send the second letter. I had same thing with Lowell-life - they sent me a letter the day before the 12+2 days was due saying they do not have the file and are going to OC to get a copy.

    Also certainly DO NOT SIGN anyway!!!! Leave that one for the 12+2 days as well!! The letter does NOT need to be signed for them to act on it!

    Got a letter from Lowell-life today. Its a unique chance of a lifetime offer to "buy back my account". Great its the ebay of the DCA world - all I have to do is put in a bid and if it meets their reserve then I can have my account back and they will never send me a demand again and remove all entries from my credit reference files.

    One slight snag.... they have never proved to me that they own the account in the first place so am I really going to buy back an account?

    So do I send back in their return envelope a bid of ZERO and a little note to say I am not paying for anything they cannot prove they own? Joking - I am not going to send anything back althought I could be tempted by their other offer in the letter to set up a DD for £40 per month (debt for £731)..... NOT!

    Made me laugh!!

    Hi Simon

    You will have a reclaim here hunni if you feel you were mis sold in anyway, please check this out here:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

    There you will see some useful info and a list of PPI mis selling, if any of this occurs to you then put that in your complaint - reclaim letter, there is also a template letter on that link to help you but add as much info as you can to back your case.

    They have 8 weeks to respond - post by recorded delivery in order to keep a check on the timescales.

    Another letter maybe required if not successful first time round, or until Halifax state this is the final decision and enclosed a Financial Ombudsman leaflet, if you let us know what response you have we can work on it from there step by step.;)

    Do not be downhearted if the first letter you receive from them is a fob off, this tends to happen and they generally use standard fob off letters, but don't let that stop you hun, keep fighting.

    Look forward to hearing the outcome on this, good luck.
