Here are the scans of the credit card conditions that were sent under seperate letter from The Halifax to us, I hope someone can advise soon,
Regards,
Simon

Its hard to answer as the scan of aplication is vertually unreadable, but i can see what looks like the APR quoted on the fourth page, but nothing to tie that page to the first three, if you cant find any way to connect it, niether can they so have no proof it belongs to them.
As far as i can see this is what it says it is, an application, nothing more, its not a credit agreemant, while thats not always the case if the prescribed terms are included in the four corners of the signed agreemant, it is not in this case as it has been presented to you.
Unless the fourth page is the reverse of the third and they can prove it is they will strugle to enforce it IMO, unless there is anything in the text i cant read to tie all that lot togetherThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….0 -

Thanks,
On page 3 of the copy of the application form where I signed it states
This is a credit agreement regulated by the consumre credit act 1974
I think I need to try & re-scan them do you think?

Hi All, I have just been in contact with Check my file whio i acess my credit files through about Defaults shown on my File and no CCA from these companies yet.
This is the response I just got:-
Hi Simon
Thanks for your message.
We cannot provide you with a subject access request as only the agencies themselves can do this and we are a third party. However what I would suggest the best course of action to be would be to dispute this information with the agencies. This will then require the lenders to prove the validity of the entries and if they cannot do this they will be removed. If you are happy for us to do so we can do this on your behalf with Equifax however you will need to contact Callcredit directly to do this. The best way to contact them is by email at info@callcredit.co.uk
Regards
Alex

Anyone got a template letter I could send to the other agency?

Hi Guys,
Cracking site...
On 10th September 2008, I sent a CCA request to Vanquis. I received no reply so on 20th October 2008, I sent them a non-compliance letter (both by recorded delivery)
To date, I have received nothing at all from Vanquis, they have tried calling me but I either ignore them or if I fancy an argument I speak to them and ask where my CCA is? (They really are snotty blighters)
Now what do I do...it is clear that they are ignoring my requests
Any advice??0 -
Hi all,
With regards to the Halifax Credit card supposed CCA I have posted Should I chance my arm & send them anotherletter stating that an application form does not constitute a CCA ?
I have checked my credit agreement for my capital one card and when I received the card I did get a CCa from them so should the Halifax have supplied me one of these & Not a signed application form?
If the answer to this is yes any ideas where the latter template is that I need to send?
Many thanks,

For template saying not valid CCA then have a look on this thread.....

My opinion is that it if you are sure it's NOT a valid CCA you should send the next letter. I'm sure someone else will be along to confirm that.0 -
