  • thanks for all your support stapeley, shiny head, blindas a bat and swt61 its been a tough few days but we stuck it out and i'm glad we did next step 12+2 letters going to them for cca as none arrived from 1st letter :j

    I am not at the moment going to court you will see from all of my posts that I am going through the CCa Process.

    Some have supplied but most have not:j

    I am waiting for a reply on where I stand on my last post with an assumed CCA received from a credit card company.

    I am just waiting on the rexst & hopefully will be guided in the right direction for my responses.

    Told you so . Can you just give us the back ground on why they were taking you to court etc . And what your defence was . Can we also know what the Judge said ? cheers
  • :rotfl: ok stapeley but being careful, background is Oh had stat demand served for an account that was in our dmp and had been for 2 years no payments missed etc etc, so OH applied to the county court to have it set aside on above grounds. dma sent us proof of payments fro last two years and soa to send in with stat demand to court which OH did, we got a copy of letter from dca solictors that they had sent to the court claiming we had missed paymenst and that applying to set stad aside was not an option they asked to be excused from attending, so off we went the judge first informed of the just said letter from dca solicitor then went on to ask why sta demand was for over £1000 pound when original debt was 200 Oh said he presumed it was charges and added interest judge set it aside on grounds that the amount of debt owed was in great dispute and that dca had to satisfy him of how they had arrived at the amount they were caliming he also said they needed to get their act together:T

    Its a :beer: :j . That should put them in their place then. But just tread carefully . Wait to see what Judge actually puts in his Judgement . I presumed you had disputed the CCA sorry . But as they want to play hard ball , you have done the right thing requesting it now . It could be insurance against any future action .
    I must agree with the JUDGE , it,s unbelieveable they went for SD on a debt which was that amount . Keep us up to date . Well done again .

    Here are the scans of the credit card conditions that were sent under seperate letter from The Halifax to us, I hope someone can advise soon,:confused:

    Help?

    Can someone explain the ins and outs of the CCA letters? Got a loan and a credit card, have prpeared a letter asking for the CCA, but what happens after? how long do I leave it? What if they dont reply? What if they do? Sorry for the questions, desperate to get things moving on this, just to see whether or not we have to pay back :)
