    How can you go to the small claims court and say yes its available but its in a diffrent counrty surely it has to be in the UK
  • It's a grey area, but the fact that kingfisher owns castorama, where suitable alternative exist, and buy stock from soulet, who confirm stock is available, i would think it is acceptable, and it's still in the EU, so shipping isn't a big issue.

    Just as they own it dosent mean they can get the stock they will be classed as another company and may need the stock to demand there sales figures.

    I would check that out with a solicitor before going to the small claims court

    The Sale of Goods Act says if you can go into the market and get the same product, the damages you are entitled to is the difference in price. I don't see why you couldn't go oversees. However, the common law requires you to mitigate your loss ie to minimise how much damages you sue for. I would say if there was a similar item in the UK costing less than an identical product in France, you should go for the cheaper option but use the details of the French product as evidence of an existing supply of the product and of the cost of it.

    Looks like B&Q are feeling the pinch.
    B&Q-owner Kingfisher has said it is to shut 22 of the DIY chain's stores as it faces up to what it describes as the "toughest" market conditions for years.

    Feel sorry for the staff - But sums up the shambolic way B&Q is treating its (now EX) loyal customers.

    A 33% drop in profits is pretty devastating and probably explains why they weren't so keen to supply the goods as advertised and take the hit for a few hundred customers.

    Still, I say kick them whilst they are down. If cash is a problem for them, then they don't want the added cost of defending themselves in small claims court up and down the country (could you imagine the mileage claim from their solicitors), so when at court, if they do send someone it will cost them, and if they don't send anyone, then you can argue your case better and win.

    Still haven't had my refund either as yet (or vouchers) but this only makes my case stronger.

    Sent my letter a week ago - no response to date. 7 Days then its small claims for the table tennis table for me!

  • I had someone new from B&Q contact me today to tell me that he was now dealing with my case and that if i had any queries i could email or call him. So i listed my complaint (again) and told him that i wasn't accepting a measley £20. He then mailed back saying that he was no longer going to enter into any correspondance with me about the subject.....How can you contact someone and then tell them that you don't want to speak to them when they tell you that they have a problem...??

    I was going to drop it but now i'm more determined than ever to go to court!
