    Yes. Forms were completed and printed this week adn will be posted tomorrow. I ave been very slow but all is now finally done!!

    I hope it works out...I am holding fire as I found the whole thing confusing.

    I have got the relevant forms, but its the legal process aspect that is putting me off.

    Please let me know how you get on

    Mine will be posted today. All done. It is confusing but I had a lawyer at work who helped me. IF you PM me your phone number I am happy to call you to talk you through it. Will take about 5-10 minutes. Will be my pleasure.

    Well I posted it and the County Court returned the form to me. I have since resubmitted it and await the next steps!....

    Received the defence claim from B&Q today - and I must admit their defence is pretty weak. They are quoting their T&C's - but it makes no difference - a contract was formed by taking payment - so I couldnt care less what their T&Cs state!

    They also say it was a mutual mistake - of course it was - like I new they had a stock system error when I placed the order!!!

    They also say I could get a similar product elsewhere for the same value - well if thats true - then show me!!!

    Looking forward to the court hearing....

    Oh yeah - and they say " The defendant notes the mint online statement provided by the claimant but pending further disclosure makes no admission in relation to the said payment"....and then two points later state "B&Q admit that a refund was made to the claimant on XXXXX 2005" - Total contradiction.....!!!!!!

    Unbelievable!

    They have admitted they had a stock system problem.

    I got my acknowledgement from the County Court today. B&Q have until 28 November to file a defence. I will update you when I hear from them. Looking forward to the case! Court fees cost £50 but I now have £40 in vouchers to use towards that - and I refused the other£20 that they sent me in return for signing away my rights!

    Latest update. The fools at B&Q are using a law firm in Plymouth and are fully contesting the claim. I am happy even if I lose! B&Q have paid my court fees through the vouchers they have given me and they will blow a fortune (certainly more than my claim) on defending their stupidity! No suprise they are so stupid given their past record!!

    Glad that your cases is progessing nicely. I'm still waiting to hear what B&Q's response is to my claim. I hope that we all win our cases and teach them a lesson about stock-taking, how to process orders properly, and how to give good customer service (but I won't hold my breath waiting for them to wake up to themselves!)
