This is turning into a complete joke, they must have thousands of pounds in the bank which they have taken from people for goods that they had the inability to supply...it looks like they are going to need it to pay those lawyers....
  • I have just phoned my house insurance co (Royal London) & they have confirmed that I am covered for legal protection. They are sending me the neccesary forms tomorrow.

If your insurance co. accepts your claim then you have nothing to lose. I knew I had legal cover on my policy but did not realise it would cover me for small claims till now. I thought it was for big legal issues.

Big Thanks go to Jld1 for the suggestion.

Can anyone confirm that it would only be possible to take B&Q to the small claims, if they have taken money from your credit card. From what I understand, only if they take money from your card do they enter into a contract.

Myself, they never took any money so I doubt I've got any ground to take them to court - My complaint is more on how they've handled my attempted purchase and there lottery style allocation of stock.

I also have legal protection on my house insurance with Direct Line

  • No money was taken from our bank. My understanding is that so long as you made every effort to pay (ie supplied credit card info) and if the paperwork issued by B&Q led you to believe that you had in fact paid, then B&Q's decision not to collect the money may not necessarily prevent a claim.

Pick up the phone and call the direct line legal number it should be located in the inside cover either front or back of your policy document. You have paid for the use of this service in your premium so why not make use of it, the least they should do is identify if you have a valid claim and if so pursue it on your behalf.

  • I had months of hassle after an online purchase (they kept on canacelling delivery).

Eventually, spoke to some kind gent who refunded my delivery (£10) and sent me £40 gift vouchers.
  • i dont have legal thing on my house policy but can add it for £16 . could i add it and still claim even though the event happened before today as the problem has not risen as of yet that i need the legal acction????

I would not have thought so. But it's worth asking them anyway. It would be similar to taking out a life insurance policy after someone has died.
  • just had the call from B&Q to offer me the £20 good will gesture and a full refund. i said i do not want a refund and she said you have got to have one weather or not you want to take it further.

Please don't let that deter you. I should think that most have had refunds by now or will do in the near future. It's up to you whether you accept the vouchers but if you do it will be full & final settlment & you will have no come back.
Try emailing your local press' newsdesk your story to see if they will do a feature for you. If that fails then take it to the small claims. Have you got copies of everything to do with your case?
I have kept everything right from the very first order to a copy of the letter I sent when returning the Vouchers on Tuesday. It amounts to rather a lot of paperwork.
Keep going Mum we'll get there in the end.
