  • My solicitor said that I should:
    Send a letter to Ian Cheshire declaring that as a consumer, they have been in breach of contract, etc. State what I think I am entitled to, and say that i'll be pursuing losses in the small claims court.

    I told him that they have refunded me without my consent, too, and he said that unless I consented to the refund, they can't use that as an excuse for the matter being settled.

    I'll probably have to buy a table tennis table (of same kind) and sue through the small claims court for the difference (as long as the difference is less than £250).

    Does anyone have any idea of how many people are involved, the breakdown by item not received? Also, has anyone heard ANYTHING from watchdog - despite emailing and phoning, i've heard nothing.

    Previous poster, can I refer you to my post above yours. Was told the same thing about 'see you in court' so B&Q just want to wear us down and limit the damage further.

    Trust me, we will win in court, they know this, that is why they are inviting our legal threats (to see how many they get and then depending upon numbers decide either to defend or pay-up). This is classic risk management strategy (I do this for a living) so send off that letter so that they can tot up how many/howmuch.
    Anger ruins joy, it steals the goodness of my mind. Forces me to say terrible things. Overcoming anger brings peace of mind, a mind without regret. If I overcome anger, I will be delightful and loved by everyone.
  • Oh, and my solicitor said that if you go through the small claims, they have to come to your local sheriff court, rather than you having to go to their's.

    I'm surprised that none of the papers or watchdog have shown an interest. My solicitor did say that the best enabler is often bad press. I don't know how best to do this. I think i'll contact the Scottish Sunday Mail (The Judge) with the details, but don't hold up much hope.

    If any complainants want to contact me by PM, please do so, detailing :
    - when they ordered
    - what they ordered
    - when they heard they weren't getting it
    - how much the item cost
    - how much it should have cost
    - Are they under English or Scottish Law

    I'll then contact the Sunday Mail about it.
  • Not sure if this has already been mentioned, but if you are forced to go down the legal action route, sometimes house insurance includes legal protection facility which will cover the costs of legal action.

    Our insurers, having seen the contract and paperwork, have accepted our claim to take legal action, so they must think we've a reasonable chance of success.

    Hi all

    Just to let everyone who PM'd me know, I have sent everything off to Watchdog and am awaiting their response. I have over 50 people on my list who have been let down by B&Q, so hopefully Watchdog will react to the numbers and realise that it is only the tip of the iceberg.

    I have also written to the consumer page of a national magazine in the hope that they will be able to assist us, and as soon as (hopefully when, and not if!) I hear back from them I shall post on here.

    Please rest assured that I am still trying my hardest in this matter, and Caitlinsnanna is now helping me out because, as some of you know, I have suffered a number of personal crises over the last couple of weeks which have left me slightly the worse for wear. Thanks to everyone who PM'd with me messages of support, it has really helped during such a horrible time :)
  • Just called Direct Line Family Legal Protection - and they're sending out a form for me to complete with all information.

    "As a legal protection policyholder we'll meet your legal fees and costs up to £50,000 per claim for the following situations:
    - Faulty goods or services you have bought including a holiday that didn't live up to expectations.
    - Employment claims including unfair dismissal, redundancy and discrimination on the grounds of sex, race or disability.
    - Civil claims relating to the ownership or occupation of your home including boundary and neighbour disputes* .
    - Defence of actions against you where you have privately sold personal goods.
    - Personal injury claims including accidents at work, in public places, medical and clinical negligence. "

    They say they'll have a good look at the stuff I send back and appoint a solicitor if necessary to pursue the difference between what I paid and what I would have to pay to get the same item!

    ordered a fire from them on 8th, rang up last week said out of stock but coming back in, rang again today....discontinued no more stock..........
