plum also sell a very similar swing and lide set to the b &q one however it is slightly different which means I don't think I could use "loss of bargain" Damn.0

an interesting point for those whose card's have been refunded.
I ordered some kitchen doors from them and they let me down. I asked for refund and was told that B&Q systems only keep the last 4 digits of your card due to data protection therefore I could only have a cheque. Interesting that now they are suddenly able to put money back on people's cards.0 -

Don't get too hung up on Loss of Bargain (that's stage II). First, you establish that a breach of contract has occured (non-delivery for instance), then you have to establish damages/compensation, and the law usually looks for a simple way of calculating this, in this case, loss of bargain comes into play. You may also have to establish unfair terms and conditions (as B&Q most certainly are - but anything that gives the supplier an unfair power over the buyer could be argued as unfair)
Damages for loss of bargain are designed to put the customer in the same situation as if the contract had been performed. (eg. for non-delivery of goods), the customer will be entitled to damages reflecting the differences between the price paid under the contract and the actual value of the defective goods. So you could interpret this as B&Q need to give you the equivalent value of compensation to put you in the place you should be had the contract be carried out (ie, you should either have the goods or money to that value) and not specifically get the exact same thing elsewhere.Anger ruins joy, it steals the goodness of my mind.
