    sorry bigade , wasnt being very sympathetic to those who havnt got theirs yet , or to those who are not going to get them .

    just seen one seller on ebay who bought a few of these plums ..... looks like he had 4 or 5 , he kept one sold 2 out of auction for £200 and has this one left

    and no its not my advert by the way ... just trying to help .

    £200 is still a bargain i know ..... but i expect it would still be a bitter pill to pay anything above the £97 as first advertised

    I was in the process of drafting a formal complaint to B & Q but thought I would give their customer services a last try. Spoke to a Richard on 0845 609 6688 only to be told that he is based in head office and does not take complaints. He provided me with another (0870) prefixed number and advised that he could do nothing at all about the query. I think the whole thing does get a bit confusing and really it all about a big corporate body, B &Q bullying us into submission. I am currently filing a complaint via https://www.consumercomplaints.org.uk as it appears not only can https://www.diy.com not handle orders properly, it does not deal with complaints. What irks me most is that the someone from the delivery company phoned the day after the delivery date, to inform me that the TT set was out of stock and therefore they would be effecting a refund and he could not take any complaint because he was not B & Q. Is it reasonable for him to phone me regarding an item over which I have not contract with?
    Do you make things happen, watch things happen, or just wonder, what happened?

    Anyway, after a quick bit of surfing, found this on a legal website about "loss of bargain":

    "If the contract relates to the sale of goods, damages can be calculated according to the 'difference in value'. This means that if your supplier fails to deliver goods, the damages will be calculated to match the difference in value between the contract price and the market price of the goods, on the day when delivery should have occurred. See the Sale of Goods Act 1979."

    This means we should be entitled to £359.95 - £97 = £263 approx. in damages. I wonder if this can be done through small claims court.

    Will try to dig out a bit more later, but got to get back to work now!

    Did they actually take payment from your cards?
    next are banks.......lloyds must rate as the wordt bank ever......for the amount of muppets who work for them you would have though ther is a braincell there somewhere
    When I applied online for a Lloyds TSB account (as they were offering £50) their website insisted that I had to use the official post office version of my address - Flat C, Number 36 (even though it isn't a block of flats, it's maisonettes)

    Then their new accounts office in Cardiff rang me up to say the statement from my existing bank couldn't be used as evidence of identity as it showed a different addres - 36C !!

    I doubt we're going to get anywhere with direct contact with B&Q - they KNOW they're in breach on contract and aren't going to want to fork out £260 for everyone who ordered a table. Perhaps if trading standards doesn't get us anywhere, the best plan of action here is to make this public - i.e. go direct to Watchdog etc

    Just a note about all this, I don't want to be coming across as mercenary or money-grabbing here...and I didn't order hundreds just to flog on Ebay, I just want my table tennis table - my kids were expecting it and are now disappointed.

    Just to say - I'm in with you guys on taking this further. Going to ring B&Q later to make sure they havent put the refund through. I have already files a complaint on consumercomplaints. Not heard anything though. Files it on Friday.

    Will let you know if I here more. The loss of bargain has been raised on other forums before - dont know much about it though.

    They have definately formed a contract by taking payment through - it even states it in their terms and conditions

    Just had a call from Trading Standards. Apparently all that B&Q need to do is offer a full refund, any extra payment is at their discretion and not necessary as far as they are concerned legally.

    Anyone else heard anything ?
  • I was expecting delivery tomorrow - phone deliver2Home to check the numbers they had for me - and they said out of stock - not going to be delivered!

    I phoned B&Q and the girl was very sorry, but the manufacturer has let them down and they will not be getting any more - can she refund me.

    I said no - let me find out how i stand on this...

    Really quite disappointed.

    The order was accepted by B&Q 15 July and money taken from credit card shortly after.

    Not sure what to do now!

    Disappointed at trading standards - once a bargain is made, you should not be able to refund and reneg (but I am biased).

    I've still not had a chance to contact them myself, but will be doing so.... I wondered if we'd get this response from TS, but then I suppose it's not up to TS to enforce contract law. It may be up to us to take them to the small claims court then, perhaps I'm missing something here, but I don't see how we haven't got a clear case for loss of bargain through breach of contract. I guess B&Q are banking on the fact that most people don't want to make the effort to pursue it this far. Never done it myself before either, but the way I'm feeling right now makes me determined to do it.

    I'll post again when I've spoken to my local TS.
