OH and I had Default Notices from HFC Bank this morning. We are 2 yrs into our DMP with CCCS.
Does anyone know if this probably means we are now going to get passed over to a DCA?
Its amazing how these letters can still cause the racing heart and the wobbly knees even after I have read all the advice on here and other forums. I don't think I will ever forget those initial awful months at the start of the DMP.
I have asked CCCS by email to forward the current I&E sheet to HFC. We are due a review next month but I am not sure how up to date HFC's records are.
I will write to HFC to tell them to expect something from CCCS.Naturally, it'll be going Recorded but can it go Recorded if its going to a PO Box?
Hi Janey,
A default notice is nothing to be worried about, it’s a legal requirement ending the contract between you and the creditor (it will stay on your credit file for 6 years). So what a creditor then could choose to do is pass the debt to a collection agency. If they do just let us know and we will make sure the payments then go to the new company for youI am a Debt Counsellor that works for the CCCS and have specific permission from Martin, to post on these boards to try and help those in debt. Read more information on the CCCS and what it does in the Debt Problems: What to do and where to get help article.
CCCS is a registered charity, and there is no charge whatsoever for any of the services we provide to our clients. geoffMr1 thanks for your reply. Luckily for us (but not for HFC) we live in rented property. We sold a house last year and had a bit over £20000 to try and offer F&F to creditors. When we approached HFC they offered a 30% reduction but this would have taken well over half of the money and we owe a total of £69000+.
We tried with one other creditor and they were the same.
Spoke to CCCS and they said to forget it for now. So the money is in a high interest account working for us. Haven't touched a penny so feel half virtuous and half worried in case they find out we've got it.
But if we paid HFC, the other (loads of) creditors are being disadvantaged.
I know how you feel. I have a few thousand in an account which was recently giving to me by my mother who wants my wife & I to take our kids away for a holiday as they have really had to suffer through all this. I'm worried when it gets to county court, which it will do when they go for a Charging order that they will want me to produce all bank statements etc & then I will have to justify the money or if I've been on holiday by then have to justify where I spent it. The money was only giving to me to take our kids away not to spend on debts but I doubt the court would see it that way!!:j DMP mutual support thread member - 135:j0 -

You do not have to show any bank statements unless they issue you with an order requesting this.
When did you receive the documents
have you acknowledged service of documents?
Are you defending the CCJ - have they applied any charges that are unfair to the account?
If they don't get a CCJ then they can't get a charge on the property. If they do get the CCJ you can still try and stop the charge0 -
I had a similar problem but the CCCS were fine with copy bank statements to prove income.
thanks for that well i will ask dh again to getit and if we haven't got it by next week i will just send the bank statement with dh's wages highlighted, least this means we will get set up quicker, before i go into hiding again!0 -
hi all just setting up dmp and my biggest worry at the moment is the phone calls from creditors, only had one so far hsbc which we have a o/d with that is £70 (£60 of which is made up of their charges!) over our agreed limit. they constantly ring my mobile etc. spoken to them twice (as keep avoiding them!) just saying, no i cant pay, and that i am in touch with cccs, but they still call and i have to repeat everything again.whats the best way to stop the calls? shall i get my number changed? or will they get access to my new number somehow? any tips?0

I have been served with a County Court claim form, so they are going ahead with it in my case. If I had defaulted then I would've understood their actions, however they get money monthly (even if it's not as much as they would like). All this is doing is increasing my debt for no particular reason. Originally I had an agreement with them for £50 a month which I kept to, however after 3 months they wanted £100 a month & told me that in a further 3 months they would want £150 a month & so on. As I could barely afford the £50 the increase was well beyond me.
Oooo they are wicked b8****s
Why do they have to be so unreasonable youve been paying them all you can whats their problem?
Was it a HFC debt??
Ive just found PPI on my husbands debt with them of £40 p/m
so im going to try to reclaim this

I've requested a true copy of the original CCA which still has a few days to go before they default on that.
In the meantime I am acknowledging service & I'm saying I will be defending the claim (I'm only saying this at the moment to buy myself an extra 14 days), I can still admit the debt at any point during that time & will do so if they provide a proper CCA. However if they still have that CCA then they will definately get the CCJ against me, which is all leading to that Charge on the house they desperately want. Of course I will do all I can to stop any charge being put on the house but I have been told by CCCS & the national debtline that the judges pretty much always give the creditors it nowdays.
What really gets me is that an unsecured debt can be secured on your home. I got that credit card through HFC 14 years ago & always run my account perfectly until I hit hard times. My credit limit started at just £500 & by the end it was over £10000 so that shows I run it properly for so long. All that is irrelevant to these companies & judges though!! It makes you sick:j DMP mutual support thread member - 135:j0 -

Ive had DMP since october 2006. We pay 221.00 p/m which we will be paying for 19 years
The cccs have been great, my current worry is am about to be a student again and do not know how much income i will have p/m and may struggle to even meat the DMP payments
What is the benefit of having DMP as opposed to an IVA i have lost sight of why i chose DMP ?Debt free and plan on staying that way!!!!0 -
Hopefully they won't have an enforceable agreement.
I think you can fight the charge. They tried it with me but were unsuccessful and the order was £20 pm on a £11000 debt0
