  • Alex...I to have had problems with HELLIFAX.
    They keep adding interest and charges so I wrote a nice sarcastic letter to them and they sent me what sounds like the same one you`ve had.
    We will continue to charge interest for 6 months then will default you and pass you onto our recovery team(what you mean the same a.rsewipes who ring me 4 or 5 times a day already.:rolleyes: )

    If I ever see that Howard I`d give him Xtra.:mad:

    Unfortunately, not quite. My bad debt (DMP) finishes in Dec. 2008, but I will still have approx. £12000 "good debt" to get rid of.
    I intend to update my sig in Dec when DMP ends. I don't know why, but it'll make me feel better knowing my exact debt does not include "bad".

    Hiya guys had posted on another thread and Ras kindly helped me with a link ref guidance to debt collection but i wanted to put on here too, any other help appreciated

    "just to let you know ive had a card from Rma for the dreaded visit on monday yesterday, oh shucks he didnt turn up blow, i stayed in all day should i now write a complaint for wasting my time ? anyway had a letter from mbna finally who want me to call them to discuss the points raised in my letter ie the offer of reduced payments and being offered as pro rata payments with a listing of all my creditors.

    I am currently off ill due to depression and seen a private consultant who is now referring me for specialised therapy, so am now wondering if i could actually write to all my creditors who have not accepted the pro rata payments to tell them that due to my illness i find talking on the telephone difficult and that written correspondence is better as i can ask for help and be helped by my councellors at this most difficult time. Continuation of trying to contact me to speak with them on the telephone is not helping me and is causing me distress and confusion for me. Id rather be treated with a little understanding as ive been pro active in addressing my debt rather in hiding behind my mental state at this moment of time.

    Any one has a letter or point me in the right direction, its been hard to write this but i think i must address it in someway if it helps one more person feeling the same way it s been worth it. Also i guess its helping me to finally confront my own need to get better soon too.

    Well we started DMP in Feb., with Payplan....DFD then was 2026....had a few adjustments in budget and DFD is now 2021!!
    Bet 1st Credit still won't accept.....and still going to talk to Payplan re an IVA....not sure about entering into one but might be the alternative.

    Rayday - thank you (again) for all your help. Sat down with OH last night and went through everything and we've finally decided to give things a try through CCCS so I've completed everything online with them and we will be getting our pack sent through. Does that mean I can have a number now and join the "club"?! :D I think I'm going to need all the support you guys can give.

    Cant stay and chat at the moment as the kiddies are not behaving and getting ready for school!

    Brief summary of what happened with Nasty West ... OH rang Payplan who said they had sent three letters to NW etc and apparently NW were not picking these up on the electronic communication system.

    OH rang NW who stated, once again, they had received absolutely nothing from Payplan. This conversation went on for around 10 minutes with no joy whatsoever.

    OH rang Payplan again, who then decided to ring NW. Ten minutes later, Payplan rang OH to confirm that NW had received everything but there was a backlog!

    Argh!

    Don't take that one lying down.

    If they've fired you, without any warning for 'performance issues' then you may have a good case for unfair dismissal.

    If they are saying they don't need you any more then you are redundant and (if you've been there long enough) you should get a payout.

    You might be able to make a case saying they made you redundant because of your being ill.

    And just like creditors, they WILL do things which are not legal if they think they can get away with it.

    I know it's another fight but if you have the strength and the will, get in touch with your local CAB and get advice.


    Well I've now done a little research and it appears that you must have been employed for 12 months at least in order to bring a case for unfair dismissal, so it seems that they can pretty much do what they like in this time!

    I feel a bit crap to have been sacked, but the end result is the same, I was going to resign anyway (although I appeared to be procrastinating I knew that I woulnd't be going back there). I may actually send a letter to that effect today (I was never plannning on doing it by email :rolleyes: ) I know they will say that they had already sacked me, but if I date the letter yesterday, it will be hard to prove. I suppose I can then always say it was "mutual decision". Job day in the local paper today so onwards and upwards. As I said to DH(over a pub burger and bottle of wine last night - completely unecessary expense but I kind of needed it!) what is the worst that creditors could do, that one or two of them aren't doing already? And if i get a lower paid job and have to extend dmp so be it - based on what I think I could get, it would only add a couple of years to it, which could possibly be shaved off again with pay increases over the next few years.

    I didn't really want to find myself in this position, but overall I think I am better for it - I could have gone completely doolally and done something really silly if I had stayed too much longer. I think the AD's are really helping me at the moment - tbh I wasn't sure if I neede them at first as being away from work seemed to help quite a lot, but I really think that they are helping me to focus and not get into such a state _ some of my posts a couple of weeks ago were a little hyper and emotional!

    Thanks again for all your kind words and pm's (don't mind at all Marru btw- it's lovely to get messages of support. I will send you one later as now off to babysit for my neice - 4 months old and she's GORGEOUS) x

    Maz just seen your message and yes it is important for you to let them know that yours is a stress related illness and that you feel it is harrassement because under the OFT guidelines they are not allowed to harass so if they get a letter (recorded delivery if possible) saying that then they are breaking guidelines and you can move to formal complaints etc in the future.

    I will look for a letter or try to pad one out so will be back - today is a bit hectic got some governor stuff and work to squeeze in so a bit hurried in my response.

    Can I just clarify how are you working out pro rata payments etc managing your DMP? I do my own and use the national debtline for a budget calculator (which looks very pro!) and used to use there template letters but to be honest now they are a bit edited and expanded on but are a good rescource if you are not using them. Also if you have not done it and this goes to anyone with CCCS or Payplan I recommended going on the site and requesting a posted copy of their debtguide it is very easy to read and nice to see in print our rights etc and covers things like courts etc but it a good basic bible and makes you feel a little empowered.
