  • Maybe a ccj form NR would be no bad thing. At that point, the interest would stop and if you are on a DMP then the court is likely to agree the payments you are already making.

    Sounds like they are trying to bully you into paying more than you can afford.

    Just to lighten the mood.

    How about these replies when creditors call next time:
    - I am sorry I can't discuss this with you as I haven't finished the security questions
    - You have come to the wrong department, you need to redial and choose option 21
    - It doesn't show in my system
    - System is down
    - I have not received it
    - Your call is important to me please hold and I will answer you as soon as I have finished my lunch/read todays news paper/taken the dogs for a walk...
    - You are dialling my international number I can't help you untill you have dialled my expensive 0845 number

    I am sure you can come up with loads more :D .

    Loopy - I have in the past had notices with titles like that and with me they meant a last ditched attempt and then they were either passed onto a DCA or accepted with frozen interest.

    Even if it is a last ditched attempt before your worst fear a CCJ - like Andy said not a nice thought but the interest at that point would have to stop. And you know you are not going to see baliffs or loose your home thats why you took this step. If you read on the main site baliffs tend to visit people who ignore problems and you my lovely are tackling them!

    As for interest at such a high rate once they finally decide what they are doing with that account I think you could write and try to claim some of it back.

    Well yes and no really. They haven't actually said that they want more money (other than the "contractual amount":rolleyes: of course) and they aren't even bullying me - it just seems to be very cut and dried. Hopefully if they do go for a CCJ the judge will award them payments that I can afford and that will be that. Unfortunately tho, NR seem to go for "full repayment" in the judgement so you breach it immediately and then they go for CO. I don't quite understand why the judges are not making orders for people to pay on an arrangement? I'll certainly be in court to give my opinion if and when it comes to that - I'm not taking this lying down!:D

    Hi lostalot. You're right. When I worked in banking (don't all hiss at me!), Direct Debits were generated by the system a couple of days prior to the date they appear on your statements.

    If I were you, I'd withdraw both TC and wages money on the day they go into your Account.

    Cancel your D/D payment TODAY. So what if the payment bounces? You can ignore the system generated letter which you should receive and you can deal with any telephone calls by saying you have taken advice from CCCS and you'll be sending you a token payment when you know the way forward. At least then you will have money in your purse to meet your essentials.

    Definately for the first month or so all you get are generated computer letters where they assume its just an over sight - so I would avoid paying full payments if that means you have more to live on and set up new bank accounts etc.

    I know we are supposed to avoid telephone contact but I did just call NR. Stuck record really (them not me!) Although the woman I spoke to said that once they had CCJ, they would be in a better position to accept reduce payments and freeze interest. I would be happy with that (CCJ isn't my worst fear - losing house is) but TBH I'm even becoming resigned to the fact that if it does, it does BUT IF NR tried to force a sale in that way (or anyone else for that matter )- I would get down the OR office pronto, and declare myself so none of the barstewards would get anything!!!

    I just don't understand why they can't just agree to it now - the overall outcome is going to be pretty much the same, well better in fact if they just agree with me, rather than doing it all the hard way! Oh well, ho hum. Time to get all those letters requesting CCA's out :D

    Sorry if this is a daft question..... do you have a fully worked out DMP in place yet? If not, go to CCCS or one of the others and get one sorted. I suspect you will do better in the courts that way.

    When they ask you to complete security question, i.e DOB, address etc, etc, just tell them you don't give those details to strangers :D
