    My overdraft with Lloyds is included in my DMP ,lloyds accepted the reduced payments but because i have no income going into lloyds account now my account is over the agreed overdraft limit .I keep getting letters from lloyds saying i must pay its £100 in the account to bring the account up to date and when i ring them they say do not worry they know i am on a plan with them so i do not need to pay it .I have got another letter today saying the same i am fed up of ringing them having the same conversation with them should i just not ring them ,this last letter says you may get a default notice .I am confused have they accepted my plan or not ?

    Doesn't this count as harrassment under the government rules? There's a link to the document buried somewhere in this thread

    What I did and it was re an overdraft, I wrote to them listing the letters I had written (I never rang them!) and listing the letters they had sent.

    I put in the payments I had made and totalled all the interest charges etc they had made on the account.

    I pointed out all the time I had told them of my circumstances and said I felt they were trying to profit out of my genuine finance problems. I pointed out the sponsored National Debt Helpline and that all i was trying to do was follow the advice of Debt Helpline.

    I said I felt harrassed by the number of letters etc dropping through my door.

    The end result was all the interest and charges refunded, case of wine, payment book (I do my own DMP) and they accepted my payment plan for a year.

    If you do this make sure you write FORMAL COMPLAINT at the top of the letter. If you like I can dig out the address I sent mine to. You will know its been treated as a formal complaint when you get a leaflet back about your rights in the response and of course send it recorded delivery.

    I like that , when asked if I have a mobile, I say yes , then they always pause , as if I'm going to just give the number over like that !
    Then when they ask if they can have it I have used various answers , including ,
    "although highly flattering ,I dont think that its very professional of you to ask for my number for your own dating purposes"
    "are you flirting with me?"
    "only if you give me yours first"
    "why what have I won"
    Its funny the guys seem to move quicker than the girls.

    Lloyds is one of mine. Once the DMP is put in place, I hope they get snotty. I could do with some wine! :beer:

    After reading many of the posts here, I feel completely relaxed about what's likely to come my way when I throw the switch on the DMP.

    I'm going to insist that there are no 'phone calls and that all dealings go through CCCS. I will then log all breaches and complain long and hard.

    However tough it is going to be, it must be easier than that feeling when a week after payday, the bank is empty and so is the car and the larder.

    Bring it on, I'm ready to gallop at all the walls.

    Hey guys,

    Sorry, I don't have a cheery message today. I just called Natwest as they were leaving me a million voicemail messages on my mobile saying my account had gone into arrears. This is because Payplan seem to pay them on a different date each month - aargh! Anyway, I happened to ask them to check if I had any charges or interest being added to my account each month (I naive was under the impression that they had stopped all of these) and they are adding £50 or so a month and my payment was only £17pm! So effectively my debt was never reducing. They said they were already doing me a favour by not adding charges and halfing the interest. !!!!!!!! She said I would never pay it off if I continued to make these small payments and they only way to do this was by making a full and final offer. The first woman offered a figure of £1800 then I got a call again offering £2000! I asked how these figures were calculated and was told it was at the call handlers "personal discretion" - it's a joke! Obviously I don't have that kind of money hanging around so I told them I couldn't pay it. They said I'd need to up my monthly payments. I said I couldn't. The only other solution they said was to ask someone to help me out and pay the F&F for me... arghhh... no wonder we are all in the sh*t, these companies encourage us to handle our finances badly. The same is happening with Cahoot who are charging me lots each month. I don't even want to check my other creditors. All Payplan can do is "send a letter" which doesn't work. I guess I can keep saving to offer a F&F. The debt with Natwest is over £3000 so I guess it's a reasonable reduction, but it will take a while to save it up with not much spare each month and she said the figure is only valid for 28days and the figure next time might be higher. Who are these little toerags who sound about 16 years of age to think they can play with my finances like this.

    Sorry whinge whinge whinge, I know. Sorry as well to the new people. I'm normally singing about how great DMPs are but I really feel I've been kicked in the stomach today.

    No sympathy required, although I know you'd all be there with buckets of the stuff, I just needed to rant (and an extra £2k!).

    Thanks for your replys i made a mistake when i looked at the account number it was not my bank account it was my Lloyds credit card who i have got the letter off today .My DMP started 2 months ago so i have sent £1.00 token payments for the last 2 months they will get my proper payment from CCCS this month (maybe they think i will continue to pay £1.00 even though i keep explaining to them its just til my DMP starts).Lloyds credit card are the only ones who have said no to reduced payments .Today they have said they may consider stopping interest when they see regular payments going on my credit card account .I am hoping they will accept my plan once cccs start paying them but until then they are adding interest and i can see the balance going up .

    RAYDAY- Thanks for the info about writing a letter i will def do that ,your right about making profit out of people trying to pay there debts .thanks .
  • smilealot, I am positive that Nat West are breaking a rule of some kind by telling you to borrow money off someone to pay off their debt. After all, they are encouraging you to get into debt, to sort out theirs! It may be the OFT or Banking Code, or both. Also, (again I need to check) but I'm sure they are a sponsor of Payplan.

    There are going to be times when the creditors kick off, start slapping interest on again, but this should pass. You need to act like a parrot and repeat yourself regarding your finances.

    I just get so frustrated with their actions sometimes. How can we pay off the debt with the added interest and if we had a few thousand kicking around, it's a no brainer we would use it to pay the debt!

    Argh!

    Carlos, once our DMP started things settled down after the initial constant telephone calls, letters and ever increasing interest and fees (although some of these are still being added as we need defaults to stop it. 1 down, several to go)
