If they dont decide to waive the charges is there anything i can say in regard to rules and regulations to help my argument?

If they will not refund as a gesture of goodwill, you will need to read Martin's article and review your options. The link is in my signature.
  • Hi, I wrote to the HSBC last year and finally reeived a letter from them in August last year saying that they will not pay me out and that they are waiting to see what happens with the test case this year and have put my claim on hold. Is this happening to anyone else and does anyone know what has happened with the test case from this year? Thanks.
  • Until this test case which is behind closed doors and only 15 odd people are allowed in each time. Will be interesting. If only the banks coughed up the amount charged by them then they would not be facing this.

  • Hello everyone,

I have just done my letter claiming £200 back from HSBC - and am ready for the long wait with the test case.

I am opening another account because as soon as this is sorted I want out of HSBC - I have never been treated so badly (although smile got close). Fed up of not being able to understand the call centre people, the call centre being rude, exorbitant charges and not help whatsoever when I was having money problems.

  • I have received a letter from HSBC to say that my overdraft is being stopped at the end of this month, I currently have a £1000 overdraft and am £600 overdrawn, towards the end of last year I did go over my limit on a few occasions and was charged £160 each time, I have since managed to bring it down to within my limit. I live on benefits and so money is tight, I have phoned them(spoke to someone abroad!) and they say it will be taken away on the 26th of March, I have been into my local branch and they said that it had come from head office and they couldn't do anything. I have now sent off a budget calculator to them which they sent(haven't heard back from them yet) and after all my bills are paid etc I am left with £39.00 per month. My question is
    A) Can they do this?
    B) Is there anything else I can do?
    C) What happens after this date, and I am still overdrawn with no facility? will I be charged etc?
    Please help..
P.S. I am trying to reclaim charges from them too, could this be why they are doing this?

When you're on certain kinds of benefits, you can't be put in a position that will you cause you unnecessary hardship (ie starvation!). I think you need to get down to your local CAB as soon as possible for advice.

Also, depending on the kind of benefits you're on, you may be able to get a crisis loan to pay off the overdraft which you can then pay back interest free at an affordable rate per week (usually about £4pw).

    Hi,
I have today recieved a reply detailing the charges relating to my husbands old HSBC mastercard, which12had sent a letter requesting.

I am now really confused as it details only one charge of £20. Although I think there may have been a direct debit set up for the minimum payment each month to come from his HSBC current account, I am sure there were other charges applied to the account for going over credit limit etc.

    The letter states:

"We now enclose an itemised list of the charges covering the period in question.
I should explain, your account was passed to our collections agency in August 2004 and statement were supressed thereafter. I am unable therefore to retrieve information pertaining to this period until March 2005 when a new computer system was installed allowing us to archive a monthly record of the account."

The collection agency the account was passed to was metropolitan, who are HSBCs internal collections. How can we find out if there were other charges added to the account which HSBC have failed to disclose to us? Especially during the period between August 2004 and March 2005 when the are claiming to have no record of the account?

    Any help much appreciated.
    Thanks,
    Tracy.

    hi

did you ask for the charges under the data protection act? if you did it would appear they have complied. you can complain about this.

it may be worth asking for everything they have under a separate Subject access request once again under the data protection (probably need another £10) this should give you information such as all correspondance charges statements etc. hopefully this will give you a better idea of what they have been upto.

    good luck
