    The OP has made his best efforts to resolve the matter but has been unsuccessful & been palmed off by Abbey's response.

    He should take it to a solicitor.

    From the OP's original post, it does not sound like it was clear it was Abbey's mistake, simply an account had been wrongly opened, then naming the OP.

    What do you think was said when the brother went to the branch and filled in the forms? Dont you think that what happened would have been discussed?

    So any money paid would be a good-will guesture. However if the OP's brother thought the original letter was sent by the OP not by the bank he'll likely think that your now trying to BUY him by sending another fake letter with a cheque this time!
    Where do i stand making a personal claim for damages against abbey, is there any point? Im so furious now and feel they should receive some sort of punishment for my pain!

    Unfortunatly I don't think anything you get awarded will punish abbey, it'll be a drop in the ocean to them, and even if abbey admitted fault I do not think your brother is likely to just forget the hurt he has been feeling for the last 12 months...
  • For gods sake! Yes it is Abbey's fault but if your brother was actually close to you then he would realise the letter from then is genuine as is the mistake.
    Either your brother has reason not to trust you or he was looking for an excuse to start an arguement with you.

    If you really want to sort this out why not write to the banking ombudsman scheme? You can get a complaint form off the internet.

    OP - The time you've spent reading and writing in this thread would have been far better spent either attempting to contact your brother or another member of your family who might be willing to help OR contacting Abbey again and requesting some more assistance from them in resolving your problem..........that is, if there is a problem !

    Dude quit insinuating my issue is an untruthful account of the facts, we aint all got time to sit making up stories. Grow up will you. I came here for advice and the majority of people have been brilliant, but you are just starting to grate on me with your accusations of untruthful accounts. Get over it kid.

    I made no such accusation of an untruth, merely that you are clearly not providing the FULL account and just as you said yourself everyone thinks there's "SOMETHING YOUR NOT TELLING ME" so to say the majority are believing your account would not quite be accurate now would it as many posters have questioned the authenticity of your account.

    Regardless of the above, what's also clear is that some people have provided you with advice yet you don't want to listen to that advice as you only want to hear what you want to hear. So dude or should I say Kid, grow up !!

    There are people on this forum who have had money taken from their accounts and when they have queried the bank the reply is "we can't give that information, data protection act." The perpetrator is actually getting protection! My point being if the bank takes this stance with a genuine victim of fraud, why would the bank name you Matty in a letter to your brother?

    Incidentally you mention he was the victim of fraud previously, could this be a reason why he is acting this way now? What was the outcome of that incident?

    I think you should have taken immediate action with the bank and I feel that as you have left it so long it really won't do you any favours.

    The first statement, would imply im not being accurate with my account of events, therefore an untruth. Secondly... who said that? Please feel free to show me where i said the majority of replies are believing my account. lol oh yes, you cant. :T
