Is it only cynical me, who has some doubt about the actualit! of the whole story?

No ..... you are not alone. Certain statements .... simply do not compute? e.g.
However my brother then got a letter through saying i had opened an account, which had subsequently been opened in his name

That letter seems to be confirmation of the error by Abbey. That would almost certainly be satisfactory in the even to a complaint to the FOS. What else are Abbey expected to do?

Looking from a slightly different angle, brother might realise that there has indeed a mistake made by Abbey if OP takes it to Ombudsman. I must admit I would have done this already to "clear my name" and I would have made it very public knowledge that this was what I was doing. I can understand just why OP is feeling so aggreived ~ its not a money thing.

get the bank to phone him simple as that,ps no way will you get compo
It is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.

From the chronology of the OP - there would appear to be no reason for the letter? The brother would (seem) to have been oblivious of the account otherwise. Would they have similarly written to anyone else with the same surname - had the error been made with them and not a relation?

The Banks are normally the first to plead 'Data Protection' if you even hint at discussing something outwith your own account(s)? So I find it too curious they would write to a different customer, saying say 'Mr XYZ has opened an account ... etc'.

Perhaps the letter was part of the response to the complaint. "whoops we opened an account in your name in error, please disregard anything sent to you about it". Unless we see the letter, how do we know?

The bank have created this mess.
It's easy to see this happening if the bank letter was not worded correctly & the bank has covered their backs giving a vague description not admitting any liability.

Insist the bank write to your brother clearly saying it was their mistake.

Why is that? Because you dont agree with it? Or it hasnt happened to you?

This is NOT a financial thing at all, and as an above poster said hardly a scam, i run a successful distribution business and hardly need to scam £500 from Abbey, its a principle thing, they messed up and should not have, and have never apologised, only sent a letter to my brother saying an account had been opened in his name, no mention of an error by abbey, just that it was meant to be in my name. My brother didnt believe they could make such a mistake, and it has spiralled since then.

If you feel that this issue "doesnt add up" then stop replying. Remember the forum etiquette? Courtesy. The fact that you lot like to pick holes in every issue written, which seems apparent from all posts on this site, only serves the purpose of creating forum arguments which are entirely unnecessary.

    There are 3 main points:

Firstly, i missed numerous payments which were delayed by 5 days whilst they opened MY account, remember i waited 5 days for them to open an account, which ended up being opened in my brothers details.

Secondly, they then sent him a letter which was written by some kind of gargoyle, in that it was worded as though i had opened an account in his name, and as regards the above poster mentioning data protection, they clearly stated on the letter that I had opened an account which was subsequently opened in his name (They hardly worried about data protection there did they?!). No mention of error by Abbey themselves, just a inconvenience and he even had to go to the branch himself to cancel the account which had been opened in his name in writing.

Thirdly, Not even an apology from Abbey, in writing or verbally, is the annoying part, and they still write to me asking why im not using my account. Duh, take a wild guess, if they cant even open my account in my name, im hardly going to trust them with high value payments now, am i?

So to all you "Haters" out there, grow up and stop picking faults with peoples posts. You may think they dont add up, but the above issue is gospel and you need to find better things to do than sit around creating faults where they simply dont exist. My brother and i had a great relationship prior to this, but i have to also agree that, if i received the letter my brother did, i would be very dubious as to how an account had been opened in my name.

Finally, thank you someone who understands. It is not for financial gain, bearing in mind anything i achieved would be going straight to my brother with a PROPER CORRECTLY WORDED letter stating this is an error by Abbey staff, not an attempt by me to open an account in his name.

Abbey are allowed to get away with major mistakes like this because nobody challenges them, remember afterall, it is FRAUD! What would happen if we PURPOSELY attempted to open an account in someone elses name, probably a 5 year jail term. Abbey though? Nothing. Send a letter and its forgotten about isnt it! And it certainly shows just how stringent their verification procedures are if they can reach account opening stage with someone elses personal documents. Doesnt it?!

It needs more people to challenge them, not sit back and tell the ones who are going to challenge them, they are in the wrong for standing their corners, or they are lying about their actual issue when they came here for advice. Think about it, hardly helpful are you.
